Hi,

I was hoping for some advice. I have finally started the process of claiming back DD charges from my bank and credit card company (I figure around £5500 in total). Like many others my credit score is dead.

 

Could i claim damages for the bank/credit card company witholding my money? i.e. it is because of them sucking all my money every month that i was not able to maintain repayments on other agreements and hence have an atrocious credit score.

 

Any help would be appreciated.

The credit score is not deemed as public information under the DPA, therefore damages is an issue that could be easily challenged, and leave you with a horrendous bill should you lose. By taking them for charges and inrterest, you have a fairly easy task of seeking recompence - no point making it harder than it need be!

Yes, I quite agree. Claiming 5k back should ease the burden. However, if I could link the date of the charges with information in the credit report and prove that if they did not apply the charges then it would have been easier for me to get normal credit instead of going to sub-prime lenders which charged far too much. Yes, a long shot that could cost me a bit in court charges, but saying that, you never know...

Yes it was here in Cornwall. I can't recall exact details but she had already won her refund and was going for damages but failed.

 

However there is this case http://www.consumeractiongroup.co.uk/forum/rbs-bos-successes/49470-contractual-interest-details-case.html which had some element of damages involved (fairly insignificant compared to the contractual interest tho)

 

 

edit - on re reading the thread myself I notice the damages aspect of the claim was nearly £1000 so not insignificant at all..
