Hi everyone, I joined this site a few days ago and would just like to say 'what a great site', very informative.

Anyway, im planning to claim from HSBC andand currently going through my statements (I knew I kept them for a reason), ive just got the statements from 2006 to go through but so far my charges add up to £1800, with this years, im guessing nearer £2300 but ill have that sorted later.

The first question I have though is, my Preliminary approach for repayment letter, do I send it to my branch or to HSBC head office?

Hello and welcome. Either really, I think people have had luck both ways but I'd suggest Head office and always always recorded delivery!

Good luck and keep going - sing out if you need help/geeing up/singing assistance!

Just a few more questions (I know, im a flippin nuiscence! ):

1. Will their 14 days start from the 20th December as this is the day they will receive the letter?

2. Do I need to give them any longer due to the Christmas break/Bank holidays?

3. If I get a reply (even a fobbing off one) does that affect/extend their 14 days?

4. Will making claims have any effect on my credit history or any checks that can be made on me? (ie, financial and police checks).

I ask as I work for a secure company that perform checks on their staff every few years including the above.

Thank you.

  • 2 weeks later...

Ive had a reply from HSBC saying 'Thank you for contacting us.... ....we will investigate this.... blah blah blah' but its now time to send my LBA.

The thing is, on the LBA it says: I am very disappointed that you have failed to respond to my letter of the xxxxxxxx.

But they have? Do I remove this, reword it or just ignore it?

how about "i am very disappointed that you have failed to respond to my claim by refunding the charges in question .......therefore.....

they will stall you all they can, with silly letters, promises of investigation, lower offers, nice guy phone calls, etc. just stick to the timetable.

recorded delivery is fine for all of the post - only costs £1.

How does this sound:

I am very disappointed that you have failed to respond to my claim from 19th December 2006 by refunding the charges in question.

sounds fine. now, to keep ahead of the game - you can go on mcol, have a look around, register, pop in and out at will, work your way through the addresses part (use canada sq. found on all your statements), then work through to the particulars of claim - a very easy site to do,,,,the only hard part is fitting your particulars into the limited space, but it can be done - just keep it general, include what's needed - there is a template for the mcol in the library, and if you ask, some of us will pm ours to you to use as templates (they ask us not to post them on the forum), then when this next 14 days has passed - you will be ready to answer the last couple of questions - submit and pay and that's all there is to filing!

yes, you are closer every day to getting it back.

Steve

We are at the exact same stage... I sent my first letter 18th and recieved a standard repons eon the 3rd, the same day i sent the LBA.

I'll let you know how i get on.

I may allow a few extra days for a response after the 14 day deadline since I've seen some post similar to ours where the people have recieved an offer only 70 quid short of their claim amount on the day 15 or 16. I'd rather take this and save myself the hassle of the claim.

I was thinking the same, even though its my money. £70 or so is only what they could have rightfully charged in the first place anyway (£70 total for all charges that is).

Well, I had a letter from HSBC today, offering me £1700 (I asked for £2008 ) but I WILL be accepting this. I know most people will say dont and stick it out, but im going to New Zealand in a few weeks and could really do with the cash. That and I dont want to be messing about with court paperwork while im trying to arrange my 4 week holiday!

Yes im very happy and I thank you all soooo much for your help.

When I return from NZ, ill start on Nationwide and I will take that the whole way as I wont be in a rush for the cash.
