Question re settlement.

I have sent filed my MCOL and am expecting the return of my money pretty soon, if all goes according to plan.

 

I was wondering, I have read in most threads that they pay up just after receiving the claim, and seem to file a defence on the day they repay the charges. But, what do they repay, is it the just the amount origionally claimed, or does the settlement include the cost of filing the MCOL.

 

It's just that my charges are almost double the fee but if they don't repay the fee, I basicaly lose half the money I am claiming, which would mean I would be better accepting their offer as it is for 2/3 of the claim i.e. what I lose will be less than the court fee.

They will pay your full claim including costs etc and credit your account with this. If this then puts you into credit they will send you a chq for the extra.

When settlement is received they, as gazzah says they will reimburse the court costs and the statutory interest (if claimed).

 

Which bank are you claiming against? They all seem to handle the claim differently. As you say, some settle when the defence is entered, but some drag it out to the last possible moment by way of allocation questionnaires and stays etc.
