This is very interesting that they paid back the laon amount. Natest made us take out a £5000 loan to pay back our overdraft which was mainly made of charges. We told them we couldn't afford the repayments but they said they would repossess our house if we didn't take the loan (mortgage is with NW as well).

 

I've though about adding something onto the claim for this before but wasn't sure. Now I'm going to look into it more. It's irresponsible lending if nothing else.

They said WHAT? That they would repossess a mortgage (secured) if you didn't take a loan to repay an (unsecured) overdraft?

 

I thought I had heard pretty much everything on MSE and here, and that you couldn't make me boil over with rage any more. I was WRONG.

 

They fed you bullsh!t. They lied. They coerced you into extra borrowing, forced you into more debt. And I bet you can't prove it any of it, because it will be your words against them. Arrrggghhhhh....

Just to let you all know as everyone seems to be asking the same question.....

 

" ahhhhh....but is the money on its way"!!!!!

 

The answer is yes the money was credited to our account the same day as the phone call we recieved stating they were paying our claim. We very swiftly withdrew the money and placed it in an account with a different bank!!!

 

Hope this answers all those that have asked

It does indeed. Big respect Janeyb and sorry to doubt you. My hubby had a stupid letter from Lloyds today telling him to put money in to cover a DD. The stupid thing is, they want the money in by some date in October 2005 (yes 2005) and the money was there anyway.

 

And he still wants to see how I get on before claiming his charges. MEN!!

 

Anyway - Congrats again. Great news.

Could we see a copy of your Particulars of Claim to see how this was worded, as I and many others, have probably been forced to take out secured loans to pay off these bank charges.

HBOS Plc - £9,954.65 Received partial settlement - Court 6/12/06 default removal / compensation / declaration

MBNA - Settled in full £2,377.33

Abbey National - MoneyClaim filed 26/06/2006 £883.90

Lloyds TSB - Claim Filed 11/08/2006 £2,630.00

Egg.com - Claim Filed 11/08/2006 £1,393.60

GE Money - Claim Filed 11/08/2006 £965.22

It would be interesting to see how you approached the Loan aspect of your claim. I and many others have been forced to take out "managed loans" to pay off overdrafts which are mainly due to these charges.

 

Any help on this would be much appreciated! :)

Hold on what about interest on top of the claim?

 

The refund of the £10,000 loan sum plus the charges and interest on charges was sufficient to end the claim. Certainly Janeyb seemed very happy with it.
