      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all - my first post so bear with me

 

just about to embark on a hsbc claim and decided to have a back up bank account just in case they asked me to close and been refused to what i now find out is a load of errors on my credit reference (ill be searching for that later)

 

just wanted to ask a couple of questions

 

1 - i see 6 years mentioned a lot is that the limit ? i have been with hsbc now for 21 years and they have screwed me every month :-x

 

2 - i am currently looking at the list of claimable charges thats been posted prior to my request (ty for the letter btw) just wondered if there's any pitfalls i need to be aware of first ?? or do i simply list all the charges ?

 

 

PS- i'm back in the black now and confess to being no angel in the past but my account for 10yrs or more has averaged charges of at least £150 a month so gotta be worth a look ya reckon?

I'm quite new to all this too but i'm almost sure that you can only claim charges for the past 6 years. Have you got all 6 years statements showing the charges yet or have you got to send for them??

 

Also, your charges sound as high as mine so you have to be careful with the amounts going over the limit for the small claims court which i believe is 5k and below. If i'm wrong there i'm sure one of the site helpers will put us right!!

Hi there, I am new too and still feeling my way around, but what Netty said is correct, 6 years is what you can ask for, some and 5 grand is the max you can claim under the small claims court, some people on here are claiming for longer periods and more money, but it is a different process, look at the 13 year thread just below this one.

24/10/2006 - sent Stage 1 DATA PROTECTION letter to HSBC

12/11/06 - Recieved 6 years of statements, 8 months worth twice!

17/11/06 - Sent Prelim approach letter

19/12/06 - Submitted LBA by hand and post.

03/01/07 - Recieved lame response to LBA dated 28th dec 06

11/01/07 - Called QT to enquire what they were doing, nothing, so submitted MCOL for 2703.86

16/01/07 - got a partial offer for £1926

anyone know if it does go further back and/or its over 5k what teh best thing is to do ? looking at my most recent offendign statements this could be over 10k even if it is 6yrs limit

I havn't set up a parachute account yet, in part as the FSA have deemed this practice as 'discriminatory' and frown upon it thoroughly, hopefully it wont come back to bite me!

Firstly welcome to to you all !!

 

Ok, yes 6 years is the maximum you can claim backwards !!and you count back from the date of your claim submission.

 

The maximum you can claim easily through teh 'small claim court' process is £5k - this does not preclude you claiming a higher amount but the process is slightly diferent and the cost of making the claim ewill be higher (although you can add this to the total claim)

 

Why do you think that opening a 'parachute' account is deemed as 'dicriminatory' - against who ??? you or the bank ??

 

There is nothing (subject to your personal status) from opening another bank account and for arguments transferring your salary payment to that account, nothing whatsoever !!!!!

 

It is IMPORTANT that you all read the FAQ's in here and also the info for new comers !!!! also read as much info as you can in other threads, you will glean a lot of helpful information athat will pu tyou in good stead as your claim progress's

 

Do come back to your thread and keep it updated, it allows others to help and advise as req'd and acts as a diary for you to keep a track of your own claim.

 

Don't start another thread on your claim, it makes a lot of wwork for the moderators who try and merge threads for the same members

still no parachute account as refusal on grounds of credit report failure

 

turns out my credit check reveals a 7yr old county court judgement that i know nothing about and is listed for an address i have never lived at ?? but seems theres a few more listed lower down as linked addresses that tie it all in

 

local courts have deemed the information as an error on their behalf ? and have passed it for a review by a judge

anyone else having a bad day ???

 

all i can say is - look out hsbc i'm just on the mood now to take on any establishment - looks like my credit card has been charged with an insurance from day one i have never asked for and always refused by phone every week for 3 months @ the start of owning and my other card has charged me twice for making a payment 3 hours late ??

found a possible quicker way for online bankers :razz:

 

managed to somehow convince the online system to show me every statement since feb 2001 albeit page by page and as im an insomniac i've just printed/noted all of them to a spreadsheet and even left a nice online message requesting my £2300 back (i used an edited form of the Prelim letter ) step by step guide here

 

hopefully will save time on the first request letter and be a bit more prominent on their sooper system - time will tell

 

PS- i know a halifax user (gave me the online idea) had his sorted within 2 weeks? :o

 

fingers crossed ;) im off to bed its 2 am :| and dreaming of step 3 :rolleyes:

I got a reply today in the messages section

 

Dear Mr *****

 

Thank you for your e-message dated 1 February 2007.

 

Whilst I do appreciate your comments regarding this matter, please be advised that should you intend to make a claim for any refund, you are required to specify your claims including the amount, dates, description of charges (as appears on the statement) and total claim of the charges that have been applied to your account as the bank cannot quantify or prepare your claims.

 

Please note that you can view charges applied to your account and other transactions via historic statements option on the Personal Internet Banking (PIB).

 

I confirm that you can view all transactions on the last statement plus any made since, with the most recent first, up to 90.

 

Currently you can view historic statements which includes charges up to six years old. You can do so by the following the instructions below:

 

1. From 'My Accounts', select the account for which you wish to view your statement.

 

2. Next, click on the 'My Statements' icon located on the left-hand navigation panel.

 

3. Select the statement you wish to view.

 

The screen will display the first 100 transactions and charges. You can scroll the list to view more transactions from the selected statement. You can sort the transactions from My Accounts in the following way:

 

o Date (ascending/descending)

o Type (alphabetical)

o Description (alphabetical)

o Amount paid in/out (descending)

 

You can click on the twistie next to the required column heading. The running balance will not show on any sort option other than date.

 

However, should you require copy statements, kindly confirm via this e-messaging system and I will order the statements for you accordingly.

anyone online banking can save post/delay time looking at the statements themselves online :smile:now being keen as we all are i had already been through them and applied all the info by letter to my local branch as per the guide - but was interesting to see what reply the message system would cultivate :D

i assume you get the drift - you need to put all those charges into a spreadsheet or at least a list format and then submit - this is all in the step by step instructions which i'm sure you've seen. i appreciate you are trying to do things your own way and in your own time but i'd tell anyone else reading this that we were already aware of getting your charges on-line but you must put them into a list format to send to the bank to request them to be refunded. some have tried sending the statements themselves - just put it all into the spreadsheet as per the instructions, it will save you time in the long run. also, it is worth noting that e-mail is not considered appropriate when dealing with the courts and as the early steps may become part of your claim later on - it is advisable to send all letters to the bank by recorded delivery, keeping copies for future reference.

again, flapper, no disrespect intended at all. by all means do things any way you want to do them - but as this is an open forum and newbies are always reading everything on here - i'd hate anyone to think this was the CAG approved way of doing your charges - it is not.

no probs my man - i simply wanted to point out an easier way to gain the basics of the statement info needed a quicker way i am indeed following the guide as we all should really and have edited the above to point out i am

 

note to others

 

i have already sent my initial letter and indeed recieved my statements by post and after adding my charges up on the spreadsheet i have sent them with the request letter to the proper channels as per the excellent guide

 

the above is simply a quick way of gaining the info to start your quest

i'd add to that by saying... why do it yourself? let them do it for you, they rarely charge the £10 fee and by the time you receive them you have had plenty of time to read up on the process of getting the charges back.

it's not so rushed unless you've done all the homework beforehand.

*update*

 

having sent my initial request letter (registered) in 16 days ago to both the standard complaints route and a copy hand delivered to my bank manager (signed for) (same bank we hold 4 business accounts with) i have heard NOWT yet - booooooooooooo

 

looks like a repeat copy is to be sent - ill keep ya posted

 

i did however get my para account open now though thanks to nettyg so looks like at least ill have a home for the cash to go into :):)

 

but on the flip side my CCJ from DVLA for £150 has been removed as after a lot of complaining a local judge has reviewed the judgement and i have been given a notice of allocation to the small claims track (hearing) looks like i FINALLY get my say and get my evidence seen as it was supposed to be

 

look out HSBC im on a roll :D

well time limit has just passed for my date to start court claims and WWHOA !!!

 

letter drops on doorstep this morning with offer of refund in full minus interest that if accepted will be paid within 7 days

 

part of me is saying go for the whole lot but as i'm currently laid up in hospital with tests for a brain tumour me and the wife have decided for the sake of £300 or so that i'm taking it so she has some cash in hand while im off work

 

thank heaven for small mercies at last

 

thanks for the help guys - mines a result albeit a partial one but for me its perfect timing

 

**£1984.00 offer recieved within 4 weeks and accepted without having to start court proceedings **

 

 

could admin edit my title ??

AN EXCELLENT RESULT - AND THE RIGHT DECISION!!!!

How much money would you have gotten back if you hadn't done this? :NONE. I class that as a very, very 1984 reasons very good result!

 

I'll get someone to change your title - you just get that acceptance letter back in and concentrate on getting better ASAP.
