      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can you post up the whole of the order please? Is it a preliminary hearing or the actual hearing of the case?

 

Why so late? Sorry, but I find it very hard to beleive that the court only notified you of this a couple of days ago.

In that case you do not need the court bundle - thats only for the final hearing. This hearing is a preliminary hearing to decide upon the allocation of your claim, ie, which track it would be most suited to.

Not your main evidance bundle, no, although it would certainly be advisable to be prepared to answer any questions the judge may ask you with regard to the basis of your claim.

 

You will need to argue that your case should be heard in the small claims track, as per the post I linked for you. If the judge decides the claim will go to the fast track anyway, its not the end of the world, in fact IMO the fast track has distinct advantages. The only disadvantage is that there is a theoretical costs risk, although in reality this risk is minute.

 

Turn up on time, call the judge sir/madam and be polite and concise. Argue the reasons your claim should be allocated to small claims. The worst that can happen is that the claim will go to fast track, so there is'nt any real pressure on you. Nothing can be 'won' or 'lost' at an allocation hearing. You'll be fine.

I am out the door at this moment to see the Local Court regarding Judgement by default for the Non-compliance by MBNA, partial documentation recieved and of course my damages claim. The back home and working out the charges and starting the process for refund. of course without a proper credit agreement this is going to be even more fun for the Judge.

 

I am wiondering when the Judges will get so fed up with this and call the banks in for a serious heart to heart about wasiting the Courts time.

Hi Everybody - I just started looking into my charges (since july02) they add up to over 2k - I delivered in my first letter (14/12/06) and have heard nothing yet but have noticed lloydstsb refunding charges they were to charge me today? Will keep you posted on outcomes as they happen.Ps Happy New Year

I won, Lloyds TSB paided up. But I recieved no letter just payment straight into my account

 

Congratulations! Can I ask did you go to court or did they settle before you had to be there? Also did they close your account at all? I hear after settlement some banks are closing peoples accounts.

 

Also did you claim for every charge no matter how small?

adkchum, thats exactly what lloydstsb did a few days before my allocation hearing. I got a letter a few days after the court date saying their client had paid on the understanding it wasn't an admission of guilt.

WELL DONE

 

I won too - they paid direct into my bank account - no letter ! Really rude and unprofessional but heh that means there are no conditions.

 

I would have turned up at court if I hadn't checked my bank account. So advice to everyone - check your accounts daily if you are due to go to court.

I am due in court on the 23rd and my bundle deadline was the 18th december, SCM haven't sent me anything I sent a letter to the court asking for their defence to be struck out and sent a copy to SCM, I have spoken to SCM again today, they say they still have no directions from 'their client' so it's all still up in the air.
