    • Absolutely. And not just on this subject  but if I remember correctly, it was a partial court transcript
    • i would not be believing anything you read on the net without actually knowing the judgement CCJ number and looking up the actual judgement exists and that is what really happened and if thats true,.
    • the issue with trustonline is you have to know the address used on the actual claimform else you will never find it, you cant just search by name. thats where a credit file becomes useful, as if a ccj was registered somewhere in your name , then the address would automatically be added to your credit file under linked addresses. although the CCJ itself vanishes from showing under credit file public judgements section after 6yrs, paid or not, the linked address would remain. i really wouldn't fuss about this, unless you've comms where lowell directly state a ccj was awarded against you on (date). now if they've given a CCJ number as well anywhere thats even more useful, as you can get details from northants bulk directly on the phone. it could all just be someone else with the same name as you, but its unusual for them the write as well? was this before you sent the SB letter? cause if it was, then they got your current address from your credit file, so some evidence of the judgement must be there. go look on the 3 credit file providers sites. experian, equifax and i think credit kalma  dx
    • thanks dx  much appreciated as always  sorry to keep asking stupid questions but would the register that i checked show the same information as credit files, as for  when we were sofa surfing was not registered anywhere for anything we were very ill and to be honest lost the will to live literally
    • I did read a something about comma data. I believe it might have been pra group/ hsbc where comms data was challenged by the defence. A hsbc employee was bought in to give evidence …. And the judge accepted his version on the balance of probability….. which is why I was asking

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Should we trust Sunak or the next PM to fix the Country's problems? (title revised 24/10/22)

Recommended Posts

Rwanda Is apparently the first of many places Government want to send migrants, but if they are going to cost billions collectively, then you wonder whether the money could be better spent. Other countries have the same issue and have larger numbers of migrants to deal with.

Surely it would better for UK and other Governments to collaborate on more effective border controls closer to where the migrants start their journeys. More work done to tackle the people traffickers. Asylum Centres based in safe countries closer to where migrants are escaping from.

I agree with you, UB. At a cost of a million or more per asylum seeker, it isn't sounding cost-effective.

I think the sticking point in your suggestion could be the collaboration bit. Exceptionalism doesn't make that easy.

So @theoldrouge

We've seen you ignore calls to condemn racism including extreme antisemitism from the extremist republican right

We've seen you ignore calls to condemn racism from the extremist Tory right including their London mayor candidate

We've seen you support far right candidates long associated with antisemitism as well as other forms of racism

We've seen you ignore calls to condemn racism and violence by the British far right EDL yobs (who are renowned for antisemitism as well as other racism) .. including outrageous EDL violent attempts to desecrate the cenotaph itself .. where no pro peace marchers went.

Even your support of Israeli atrocities seems only based on hate and not actual reasonable defense of Israel.

I'm struggling to understand how anyone other than a Racist extremist EDL supporter - with all the antisemitic and racist hate long associated with that group and its ilk - temporarily using the cover of hate of Muslims to stream bile, hate and division could do that?

How do you explain that?

So Sunak has finally grown half a pair and is desperately trying to follow Suella’s advice
As he has belatedly discovered the Left are attempting to subvert democracy
Meanwhile following the result in Rochdale
Starmer has been exposed and is looking like a frightened rabbit in the headlights
He has for months proclaimed that he has changed the Labour Party only to discover that the candidate that he chose for Rochdale only lasted 48hours into the campaign before he came out with anti Semitic racial abuse
Yet again the mob that you clearly support Jugg is to demonstrate in London and elsewhere
Let us hope with Sunaks apparent backing the police get stuck in instead of acting like stewards

Saw the announcement of Sunaks speech with rumors it was around extremism affecting guv ..

thought eyup, surely hes not properly sacking anderson, braverman, truss and the other extremist hate mongering nut jobs

.. and of course he didn't - just waffled a bit, apparently about his party being a threat to democracy, and went back in

So @theoldrouge @TheEDLrouge

going to even condemn the edl/far right who attempted to attack and desecrate the cenotaph yet? or just continue your cowardly avoidence?

let alone condemn the rabid antisemitic far right Pals of Trumpy

Rwanda - 1.8 million pounds per trafficked human being - the other criminal traffickers must be green with envy at the fees Rwanda are getting from the british taxpayer via the corrupt Tories - the only green coming out of this corrupt cronyistic government.

£1.8 million per individual deportee - offer 1/10th or 1/100th that as an incentive and there would be queues around the block and they would actually leave .. with a smile on their faces.

Why is this guv paying Rwanda 100s million of UK taxpayer money for nothing more than the most expensive racist dog whistle in history?

The Tory Legacy

Whats on the UP - taxation, debt and deficit, energy costs, immigration, cronyism, NHS waiting lists and food bank use

Whats on the down - living standards, Growth and Trade, Roads, Hospitals and schools

* Taxation at the highest level since WWII

* the national debt (the sum of every annual shortfall) has steadily risen from 64.7% of gross domestic product (GDP) in 2010 to 96.5% currently – the highest level since the 1960s.

* UK goods trade has fallen 15% below the G7 since Brexit

* The UK's trend rate of economic growth has fallen from 3.4% a year in the postwar period up to 1973, to 2.3% up to the 2008 financial crisis, to just 1.2% in the years since. Tory austerity for the masses - riches for the few.

* GDP per capita barely above pre-Covid levels, at just 4% above the mid-2016 level VS 8% in the eurozone and 15% for the US.

* Business investment in the UK economy lags behind the G7

* IPPR thinktank estimates the UK has underinvested to the tune of half a trillion pounds. Most visible in crumbling schools, hospitals and infrastructure, it argues this lack of investment is behind key reasons for lacklustre productivity gains.

Not a patch a zahawi or sunaks wife or MOST of the conservative MPs and pals eh? is she let alone Sunak himselfs tax avoidance and tax havens - despite Tories and shills claiming otherwise.

.. or Sunaks (Indian) family company getting massive government contracts since he's been at the top - and NOT before.

or the PPE pals who shunted millions of profit from taxpayers into tax havens

A simple misunderstanding re the house she bought and lived in for years before allowing a family member to use it rent free and then simply selling it. .. with nothing hidden or routed via tax havens.

Shows a lot that the poops and their shills have to jump on something as simple and basically honest as this while excusing the enormous corruptions of their Tory MPs and Pals eh?

doesn't matter. Everything hunt promises will either be paid for after the GE, or if they win, munged into unrecognisability to give 'get out of paying loopholes' to their doners and rich pals ..  or just dropped.

No doubts on that whatsoever

They are just stripping the final assets of the country for themselves and their pals who will give them well paid seats on the boards for doing nowt more than they've already done for their pals

Corrupt to their core - especially the new 'red wall' tories whos snouts were straight at the trough.

Why has that latest corrupt trough-meister Scott Benson not been arrested rather than just a suspension from parliament

- sounds like fraud, bribery, racketeering and a clear case of abuse of public office to me.

My prediction is that the General Election will be first week of July.  Mid Summer, with older more Conservative voters more willing to go out and University students on break. So possibly best time of year for current Government.

Some are saying May, because the migration number stats are due to be issued end of May and they are expected to confirm highest net migration on record.

I don't think they will leave it until the Autumn

Schools break up third week in July. But I think the election will be first Thursday in July.

The Tories will want a longer campaign period, because they will want to give plenty of time for Labours plans and candidates to be fully scrutinised by media and public. So it would not surprise me if the election in July was called as early as beginning of May after local elections on 2nd of May.

First point, and its a lulu:  🇷🇼 Rwanda have quite clearly stated they will NOT break international law - even if the sunak is happy to try

UK Conservatives' support lowest in 46 years in new poll

An Ipsos poll put support for the Conservatives, in power for 14 years, at 20% at the end of February, down seven percentage points in a month, with the opposition Labour Party on 47%.

It was the lowest support Ipsos had recorded for the Conservatives since at least 1978, when it began regularly tracking support for the main parties.
The previous low was 22% in 1994, when John Major was Conservative prime minister
