    • No I paid for it in full.   So, in short.    The laptop was bought new 2 months ago to take my Biomed year end exam, on 26th July.   It was also bought to have word for my dissertation.     The month to repair is the issue - I need a working laptop now for revision and exam in 12 days.    I did not think for one moment that it would expire at 2 months old - a terrible situation for a new one. I've been there this morning - they have taken the non working one to send off for 'repair'.  I've informed them that if it doesn't work or goes wrong again I want a full refund.  My only option today given the exam date was to buy another, I do not have the time to sit and wait sadly for a repair taking a month.  That was the issue - I did ask if they would honour £299 as paid before - they wouldn't.    I have paid £359 less 10%  - £323.10 that is all the Manager would do. Absolutely in future - will shop elsewhere.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

No one said it was a legal requirement. It should be, but it isnt.

But as even farages airbnb 1 month rental boy said - constituents deserve local representation - and they also deserve someone who hasn't trash talked them.

Reform UK are currently estimated to win relatively comfortably both Ashfield and Clacton, where Nigel Farage could overturn a massive Conservative majority. North West Leicestershire also leans Reform (albeit with only a small lead) due to a collapse in the Conservative vote, leaving Labour in a possible second place. Overall, Reform UK gets its highest share of the vote in the North East, East Midlands, and East of England.

If you go back through this thread, there was speculation towards end of April that Sunak was looking at GE for end of June or early July. And that the GE would be announced after end of May Bank Holiday.

I think many connected  to Tory party will have known about possible plans for a July election. My local Tory party had election leaflets through doors a few days after the PM's announcement. So this indicates that they were ready.

There were articles in newspapers including The Guardian saying they had heard about July election.

And you linked to a online article months ago saying Tories would lose to a Labour landslide where polls at the time were quite simular to current polls. So the polling has not changed as the mood of the country has not changed. 

Some think Sunak will be first PM to lose their own seat.

Yep, in other great news - as well as Boris the liar and the MuPpet for 18th century Dickensian poor houses and hungry children, sunak is also very likely to lose his seat ..

a little less likely in some polls, but same with the MP for 5th columnists and fake polls: 3p Lee

Putin apologist and trump wave farage is apparently too close to call on a few polls .. which must be trolled/bot'ed - as surely even clactonites aren't that err misguided ..

 

... sunak for one will undoubtedly be quite relieved ..

I wouldn't be surprised if Farage wins Clacton. I'm sure they chose the constituency very carefully.

Whether he has any colleagues joining him at Westminster will be interesting. Apparently 30p Lee's seat is looking precarious in some of the polls.

To be fair HB, there are a few Conservatives who at least try to rise above the current standards of 'that definition' - although it is a very few.

As a party its undoubtedly an understatement IMO
