      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

reform has what? 10 local Councillors across the country and zero legitimate reform MPs

To put that in  perspective, thats less than a quarter the Councillors Ashfield Independants (a local group) have, and less than half of what havering residents association have - let alone any major party

So lets have them in the news rather than 2p farage with his rallies of a few dozen people eh?

Sunak came across as a desperate man, throwing anything he could at the debate, in the knowledge that he is likely to lead Tories to a record defeat.

Less than 5 million watched the debate, which is a sign that many voters are not interested, probably because they realise that most of what politicians say is just part of political game playing. It is all about try to win over certain voters and not discussing policies which will improve quality of life for most people.

We could do with some help from you.

Public sector finances, UK: April 2024

 

Main points

  • Borrowing – the difference between public sector spending and income – was (a black hole of) £20.5 billion in JUST April 2024, the fourth highest April borrowing since monthly records began in 1993.

  • Borrowing in April 2024 was £1.5 billion more than in April 2023 and £1.2 billion more than the £19.3 billion forecast by the Office for Budget Responsibility (OBR).

  • Public sector receipts grew by £1.6 billion compared with April 2023, however, this growth was outstripped by a £3.1 billion increase in spending over the same period.

  • Since our March 2024 publication, we have increased our initial estimate of borrowing in the financial year ending March 2024 by £0.8 billion to £121.4 billion, now £7.3 billion more than the £114.1 billion forecast by the OBR.

  • Public sector net debt excluding public sector banks (debt) at the end of April 2024 was provisionally estimated at 97.9% of gross domestic product (GDP); this was 2.5 percentage points more than at the end of April 2023, and remains at levels last seen in the early 1960s.

  • Excluding the Bank of England, debt was 89.9% of GDP, 8.0 percentage points lower than the wider debt measure.

  • Public sector net worth excluding public sector banks was in deficit by £703.4 billion at the end of April 2024, a £93.5 billion larger deficit than at the end of April 2023.

Even the editor of the Spectator has joined the fray on the duff figures that were quoted last night.

'There are serious issues at stake in this general election, and the Tories have just released nonsense figures with fake attribution and given it to newspapers who took it on trust. I’m really not sure that this will help their chances very much.'

Agreed as you clearly have little faith in your star runners, mind you - I have less - conditional on the welcher clause I defined being part, and that we are talking about the three defined candidates: Tice Farage and Anderson - not anyone anywhere as reform might (outside chance) get someone decent to run somewhere.

I see reports of the Tories going into full 'headless chicken' mode due to the reformatory boys polling climbing up stealing 'their; voters

Well, as the Tories have encroached further and further into right-wing reformatory areas, alienating the traditional tory base, and ramping up the nasty rhetoric - why on earth are they surprised?

- They are competing for the far right vote, while labour becomes a wide centrist straddling party.

 

Looking at the analysis, the far right area  is about 4-6% of the national vote - effectively double that in lower turnouts as ... they vote hell or high water - if they can

The tories perhaps a bit over double that with their right rear end - another 6-12% , with what was a 34%ish core of Tory voters dropping to half that around 18%.

 

i wouldn't be surpriased if some polls occasionally show reform close to on a par with the TORY-poops - the tories are now competing for the far right vote, alienating their core, and NO-ONE believes they are anything but self-serving liars who wont deliver anyway.

It took less than 24 hours for The Spectator Magazine to work out that, based on Rishi Sunak’s own calculations, the Conservatives will be forced to raise taxes by £3,000 to fund their policies if they are elected in July - a thousand pounds more than the £2,000 figure used by the Prime Minister as an attack line during Tuesday night’s leader’s debate. 

The publication, which is usually of a conservative persuasion, cautioned the PM against doing a Vote Leave tribute act by using mythical numbers based on back of a fag packet calculations.

As a few people have said, if the Tories have lost the Spectator they're in real trouble.

That children's minister will be the same one who said he 'doesn't accept' that Sunak left the D-Day commemorations early when everyone knows he did? Where do they get them from and what age are the spads who are advising them? I'd say sixth formers but I think sixth formers would do a better job.

So what do we think of Sunak's non-apology? I think it was terse and insincere. It's a major blunder to leave early and it was so he could record a TV interview and repeat the proven lie about Labour's tax plans. Even the Spectator disagrees with their figures.

You know, with all these reports of soon to be Tory seat losers murmering about 'should have done the deal with Farage, should have given him the peerage

.. seems to me that Farage is/was just trying to frighten the Tories into giving him a peerage and a Cameron-esque unelected place in government so he could swan around ..

.. so why didn't they? and what with all the rampant fox paws afflicting sunaks campaign?

 

Well, would you want to inherit the godawful mess of massive debt, trashed economy and collapsing roads, schools and services the poops have created?

Wouldn't it be better to hope labour wins - then dump it all on labour and then lie that its all labours fault and pray for a resurgence in 5 years time ?
