    • I received a letter this morning from advantis acting on behalf of HMRC for a tax credit overpayment.. I am going to call them on Monday to set up a payment plan but am worried sick it’s going to show up on my credit file.. does anyone know if it will show now that hmrc are using them? 
    • I'm going to check the measurement units today as I feel this could well be happening otherwise I can't understand how the bill can be so high even when nobody there living sometimes. 
    • Totally stupid mistake struggling with money with 2 young kids no excuses so I won't bother justifying  just feeling deep regret and absolute fear for what happens next. Sincere moments of madness opportunistic and absolutely stupid Caught shoplifting from sainburies by and shop lifting plain clothed detective (penut butter almond milk chia seeds and nuts ) I only took 3 to 4 items from sainbries listed above  First time I did it In saisburies i have never done it before   Was given a letter banning me took details but no photo taken  I also had on me food items from mns that the store detianed at the same time as they wouldn't let me leave without showing a receipt as they said I would have stole those too (they werent wrong) . I have been to mns a few times in the last month and done a similar thing always general food shop  So I left the sainbries store when he let me go and left all the goods there mns.and sainsburies and did not return.  M&s and sainsbries are on the same high street   Questions  Was not caught by m&s will sainsburies share my info and will m&s be in touch? Presume they can check cctv of the time sainsburies detained me and probably find it  No police called when at sainburies  Scared that mns will also ban me after the event  or worse check cctv and have my details and pass to police to investigate  I am mortified at what I've done the detective did not mention anything about further letters / police or anything more other than taking my details and giving me a banning letter  My fear is they have told MNS and now MNS will investigate aswell they may have their own footage etc...and go further than sainsburies did at that time  Mns goods was fruit veg chicken cheese basically all food items  Advise please what could I be facing 😭

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well I wouldn't issue a summons if I wasn't prepared to go to court ;-)

 

I Actually hope they defend it, thanks to this wonderful resource I feel I will be more than able to present my case, I'm almost hoping they try to defend :-)

Thanks, I must have missed it. I actually sent it to the address that was on the reply telling me they wouldn't give me my money back, which is Trinity Road. Is this going to be a problem.

 

Also, while I'm at it, when you are on the moneyclaim site and it asks for the figure you are claiming, do you include the interest in that figure, as when you click on the button to indicate you will be seeking interest it inserts some text in to the paticulars box which relates to the interest figure, wasn't sure.

Got an acknowledgement of service from the court today, the Halifax intend to defend the claim.

 

Oh goody, I hope it gets all the way in to the court room :-)

 

Am I able to ask the court for additional expenses incurred in making the claim such as my time, taking time off work, and the general inconvenience of actually going to court?

I PM'd the details to a moderator yesterday, dragon I think it was.

 

Anyway, got a letter through today agreeing to refund the charges, plus interest & costs. However, I made a bit of a boo boo on the claim and instead of paying me £3340 they are paying me this minus the interest, so instead of paying me £3766.19 they are paying £2913.81 plus £426.19. Shall I write to them asking them for the additional amount?

Claim filed on the 7th, acknowledged on the 13th, settled today. A VERY happy bunny :-D

 

I encourage everyone to see this through, its worth it in the end.

How much did you get if you don't mind me asking?

 

£3340 plus court costs, but due to an error on my part this figure includes interest when its supposed to be another £400 odd.

 

So I'm writting to them accepting the amount but requesting the addirional interest :-)

Thank you for your letter dated the 15th March

 

While I appreciate you refunding me the ----, ---- in interest, and £120 for my court fee that you illegally took from my account, this figure is incorrect. The amount claimed was ---- PLUS £---- interest, it would appear as though you have regarded the interest as part of the £---- claimed in charges. I have enclosed a printout of my spreadsheet for your information. I would request that you now pay the interest in addition to the £--- already returned to my account

 

In your letter you also denied any liability and informed me that it was my responsibility to keep my account in good order. While this is a reasonable expectation, it is also a reasonable expectation to expect my bank to act within the law, and not to blatantly profiteer at the expense of its poorer, or temporarily disadvantaged customers.

 

You also state in your letter that you reserve the right to close my account if I incur any more of your illegal charges on my account. Are you saying that if you can’t operate my account in contravention of UK law you will close it? I think if you did this, we would find ourselves back in court.

 

Hopefully the OFT will make a ruling that your charges are unfair, and you will be forced to make your profits legally in future. I have never had a problem with being charged, its simply the level of charges I object to.

Due to a cockup in my claim, I've lost out on the interest of about £400, this was a mistake on my part not including interest in the total figure.

 

I have not formally accepted their offer although they have placed the money in my account.

 

Is there anything I can do?

 

I also asked for charges that had been made to my account since the claim was made to be refunded, they have declined to do this also, do I start another action.

 

It makes me so mad that they are blatantly breaking the law and act in such an arrogant manner, why is it that if an individual steals billions they go to prison, if a bank does it, nothing happens?

I recently won a substantial amount from the Halifax, most of it went to repaying debts. Since I won in February, they have made imposed another £450 of charges against me.

 

I called them to discuss this, and they say if I make another claim against them they will give me 30 days notice that they will close the account. I have a second account with Natwest to fall back on but will obviously lose the £1000 overdraft facility in the Halifax account.

 

Opinions/advice?

If they now owe you £450 I would take all your money from the account and leave the overdraft £450 overdrawn.

 

That way you already have the £450 they owe you, and if they wish to close your account you can tell them they can but they cannot file a default against you as the amount is indispute.

 

I would like someone else to validate that information on here, as thats what I have come to believe from other posts i've read.

 

It certainly helps you as you can credit your Natwest with £450 to help with bills etc and leaves the Halifax in a no win situation.:smile:
