Help with Statements missing??? Can we estimate 2 months charges?

I have already claimed for my Natwest and HSBC, and had full settlement for both, but I am now doing this for my mum and dad. They bank with Abbey and are owed over £4000, however although I have received the statements just before the 40 day deadline, there are two statements missing, and I think I read in a Natwest thread, that the charges for these months could be estimated.?????

 

Is this correct?????

 

I have won twice and really do not want this to go belly up.

 

Any Help appreciated...

13/09: Data Protection Act Letter Sent

02/10: Prelim Letter sent - Request for

payment of: £1957.00 + Interest deducted from account: £36.11

20/10: Received letter from our local branch. Offering part and final payment of £ 353.00

22/10 : Offer rejected by way of letter

22/10: LBA Sent

28/10: Letter from Mr Higley offering £1056.00

28/10: Rejection letter sent, accepting as part payment only

05/11: DUE TO FILE WITH MCOL - May leave a couple more days if they have not replyed.

22/10: Data Protection Act Letter Sent

27/10: Letter from Joyce Tudor advising statements will be with us shortly.

i had 2 months missing and continued my claim whilst still trying to get the missing statements. they turned up just before i did my n1 form. work out the average then enter that figure as estimated. if you want reworded forms to include estimated amounts pm me and ill forward a mail from someone who passed it on to me

neighbours £1800 with lloyds WON :wink:

IMHO

 

if you are going to enter and estimated amount you should enter a claim on the N1 (if it gets that far) for non compliance with the DPA for the missing statements.

 

Also there should be and simple statement that upon producing of the relevant data you will amend the claim accordingly.

MBNA are not your friends, they will settle but you need to make sure its on your terms -read here
