TV purchased from Argos online - paid Debit card and collected in person a few days back. I got the TV home, unpackaged it and decided the size isn't right for me. All cellophane and screen protectors remain on the product, etc; clearly brand new and I repacked it perfectly.

Argos don't want it as it has been resealed.

Customer services claim 'stores discretion as the boxed has been resealed'.

I may try a few more stores yet, but what should my course of action be as AFAIK it is covered by DSR?

As you purchased online and paid? Online? Under your consumer rights you have 14 days to return and you don't need any reason

  • Website sales - Either your business operates its own website to display and sell your products, or you use a service like Amazon, eBay, or Etsy. If a consumer chooses to ‘click and collect’ this is still classed as distance selling as the contract was agreed at a distance, even though the goods are collected in person. However, the distance selling regulations would not apply if a consumer chose to reserve goods online and then goes to your shop to review the reserved items with no commitment to purchase. That’s because the goods aren’t purchased in an online transaction as that is simply a goods reservation.

Are you focusing your business efforts on online sales? Ensure you know where you stand when it comes to distance selling regulations and consumer rights.

As dx100uk has pointed out to you:

So long as you ordered and paid for the goods in full online you have the benefit of DSR and the seller must refund you regardless of your reason for return. It matters not that you collected the item from a store nor that you returned it in a likewise fashion.

It does not matter that the box has been opened. You are entitled to test the goods for fourteen days and you cannot do that without opening the box!

Watch the time limits: 14 days to notify the supplier of a return. 14 days to make the return, from the date of notification, and 14 days to receive your refund from the date of return.

Argos have never been good at customer services

I brought a ps2 game from them as they were cheapest. the game case was very badly damaged and shrink wrap not on it. game could clearly be seen as lose in the case case had dirty shoe prints on it. Asked for a different one to be told l could not as l had damaged it. The bloke even said when he handed me it that the case was damaged and if l did not want it to say. l told him before he even gave me it.

after about 2 hours and me warning customers about the service they gave in and refunded me.

As I thought thanks . Will return to the store again this evening and inform them that I am cancelling the order as per quoted.

I have also emailed [email protected]  to this effect so have written communication to refer and pursue. They claim this email is for 'argos card issues' but with no other customer service emails it is the best I can find.

Well done. Different shops have different staff.

For customer service in future look at sainsburys. I know the CEO is the same.
