Hi, I've been using the forum and other's threads to work out where I am going. I sent the prelim approach for repayment letter, and have recieved a response offering me a low sum as the full and final payment (which I am wanting to reject obviously!).

 

Which letter do I send now? The letter before action, or the rejecting settlement one - the rejecting settlement link seems to be a step further ahead than I am, but the LBA doesn't mention rejecting their offer iyswim.

 

Where do I go from here?

Combine the two letters together.

 

Accept the money as part settlement with the understanding that you will pursue them for the rest. Give them a further 14 days (as in the LBA to refund all monies claimed) notice before you start a claim against them.

Hang in there with Barclays. They made me a well below parr offer, which I've rejected. Just got back from taking the N1 claim forms to the Court to take the next step - boy what a good feeling.

 

Hang on in there - its a great feeling taking them to court.

Hi Flamesparrow,

 

I recently needed to send my LBA combined with a refusal of goodwill offer. There is a template for the LBA and then in my thread is what someone suggested I add. Most of my letter is outlined there if you want to copy and paste it and then just alter with your details as necessary.

I too filed my claim at local court today although they shut between 1 and 2 so I had to wait for them to reopen. I must be about half an hour behind you. Shall we compare notes on how quickly this goes?

 

You are right though it was a great feeling to get in started, until all the rest of the gumph arrives that needs filling out!!

 

The race is on!!!

Heres a copy of what i sent:-

 

Thank you for your letter dated 23rd July 2006.

I have to say that I find your offer of £1000.00 some what insulting taking into account that the total Barclays have charged me currently stands at £****.00.

I am happy to acknowledge this as partial payment of the money owed to me, however I will still be seeking payment of the outstanding balance and this does not constitute closure of my overall claim.

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

 

I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.

I require repayment in full of this money, for which I have enclosed another copy of my charges. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount with interest plus my costs and without further notice.
