    • I received a letter this morning from advantis acting on behalf of HMRC for a tax credit overpayment.. I am going to call them on Monday to set up a payment plan but am worried sick it’s going to show up on my credit file.. does anyone know if it will show now that hmrc are using them? 
    • I'm going to check the measurement units today as I feel this could well be happening otherwise I can't understand how the bill can be so high even when nobody there living sometimes. 
    • Totally stupid mistake struggling with money with 2 young kids no excuses so I won't bother justifying  just feeling deep regret and absolute fear for what happens next. Sincere moments of madness opportunistic and absolutely stupid Caught shoplifting from sainburies by and shop lifting plain clothed detective (penut butter almond milk chia seeds and nuts ) I only took 3 to 4 items from sainbries listed above  First time I did it In saisburies i have never done it before   Was given a letter banning me took details but no photo taken  I also had on me food items from mns that the store detianed at the same time as they wouldn't let me leave without showing a receipt as they said I would have stole those too (they werent wrong) . I have been to mns a few times in the last month and done a similar thing always general food shop  So I left the sainbries store when he let me go and left all the goods there mns.and sainsburies and did not return.  M&s and sainsbries are on the same high street   Questions  Was not caught by m&s will sainsburies share my info and will m&s be in touch? Presume they can check cctv of the time sainsburies detained me and probably find it  No police called when at sainburies  Scared that mns will also ban me after the event  or worse check cctv and have my details and pass to police to investigate  I am mortified at what I've done the detective did not mention anything about further letters / police or anything more other than taking my details and giving me a banning letter  My fear is they have told MNS and now MNS will investigate aswell they may have their own footage etc...and go further than sainsburies did at that time  Mns goods was fruit veg chicken cheese basically all food items  Advise please what could I be facing 😭

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good morning,

I'm hoping you can help me please. 

I last posted here in 2011 and at the time I had been made redundant, was quite poorly and was being chased for lots of debt. 

 

The forum gave me so much help and advice and I was truly grateful.  Since then, I have worked really hard to become debt free.  I got a great job and started systematically repaying all my debts.

 

  It took a very long time but two years ago, I was able to get a mortgage and buy a house, and my credit score today is showing 999 on the Experian site.  I have vowed never ever to get myself into that kind of trouble ever again and am managing my finances well.  I am even able to pay a bit more off of my mortgage each month as I want to clear it quickly. 

 

A few weeks ago, I received a letter out of the blue from Hoist Finance, welcoming me and offering to help me pay off a debt to Tesco Personal Finance for £4710.17.  I don't even remember this debt and thought I had paid off everything that was showing on my credit files.  I was originally using Clear Score as they showed everything.  I have since received a couple more letters from Hoist - with two weeks between each one. 

 

The letter I received today was a little more insistent and at the end of the pseudo supportive narrative says in bold letters, "Remember it's important that you use our portal or contact us directly to find a way to manage your account (I don't have an account - not one that I have set up anyway).  Actively managing your account means that we won't have to consider taking any further collection activity on your account".

 

I have worked so hard to improve things for myself and I don't want to get into difficulty again now.  This debt can't be on my credit files or my score wouldn't be so healthy would it??? 

 

Do you think it is statute barred

Do I just ignore the letters? 

 

Please can you give me some advice so that I can do the right thing.

Hi Bazooka Boo,   Thank you for your reply.  I am on the electoral roll at my new home and this shows on my credit file.  I don't remember the Tesco Personal Finance debt, but that doesn't mean I didn't have it.  It just must have been quite a while ago so I don't know how it's just surfaced now? 

 

Hi Dx100 Uk,  thank you for your reply also.  I'm not sure what a cca request is or what it does but I will now check that out.

question your wisdom of clearing all your debts.

not sure where we recommended that without sending out CCA requests first.

looks like you might have lined the pockets of numerous DCA's giving them free money for the pub every night on a debts that might never have existed.

Hi DX, 

Thank you for your comments and I understand where you're coming from.  Not all my debts were from loans and borrowings.

 

  I got a ccj from Calor Gas because I couldn't pay my heating bill and got behind with payments.

 

Another was from overpaid Council Tax. 

Another was from a bank for an overdraft I couldn't pay. 

 

I was in a real mess.  I lost my job, was made homeless and ended up living in a caravan, and my mental health was poor.  With the help of a good friend who gave me somewhere to live, I managed to get a job, get better and getting clear of debt gave me back myself respect. 

 

I have read some of your posts and I respect your opinions and you clearly have a lot of experience of dealing with this stuff.  

 

I just want to stay clear of the trouble I was in before.

Obviously ccj's if you were instructed to pay £xxxpcm by a judge you do so. But if no one chases....   

 

paid or not, a ccj does not fall off your report until 6yrs old .

Yes the ccj has gone now. 

It was back in 2012. 

I paid it all off bit by bit. 

 

I did owe it but Calor were ruthless and didn't help very much with alternatives at the time. 

 

They refused to fill my heating gas tank up until the debt was paid and I couldn't use a different company as Calor owned the tank.  I was without heating for over a year. 

 

I'm going to send the CCA letter to Hoist today.  Thank you for your advice.
