hi I have received my statements from barclays but i understand i can only claim back for 6 years.

 

also what can i claim from the bank eg atm charges account fees can i claim them as well if some one could let me know thanks Steve

Hi Steve.

 

I suggest that you spend a couple of days reading the FAQS and the step by step guide. That will answer most of your questions.

This is a self-help forum so you must be prepared to put in the effort, yourself.

 

You can claim back up to six years. Beyond that you come up against the statute of limitations. To claim back more that six years, you will have to be prepared to stand up in court and prove that the bank had broken the law and then deliberately concealed the fact.

UNAUTH O/D FEE.

PAID REFERRAL.

 

ATM charges cannot be reclaimed as these are the charges made by the operators of private ATMs for the use of their machines. These are a legitimate charge for providing a service.

Anything marked as ACCOUNT FEE will probably also be a charge for a service provided and thus unclaimable.

Some people have claimed further back than 6 years, but you would have to search through to find them I'm afraid.

Please keep your thread up to date so it will help others.

Have a read through the threads to pick up some guide lines, and if you still have any problems or queries ask here or come to the Bear Garden.

I Have calculated that the bank owes £1365 i have printed of a standard letter from this site and with it i will be sending a spread sheet itemising all the charges is their any thing else i need. It also mentions interest charged i cant find any intrest charges maybe the account fee takes care of that thanks Steve

Steve your thread really needs to move to the Barclays forum. Could you ask one of the moderators to do it please.

 

The interest charges are what you enter on spread sheets at later stages.

On Thursday morning i will be sending a letter plus spread sheets itemising charges and giving the bank 14 days to respond i will let you know what happens next it will propably be early n the new year before i get a response with the christmas holidays and christmas post thnks for your help Steve

Today i received a letter from Barclays dated 30th of December. It says that my claim is being looked at and that they will try and respond in the timescale as in my letter. They are asking for more time to look into my complaints and they hope to find a solution within four weeks. The letter all so goes on to say it may even take up to eight weeks. What should i do know any help would be apreciated Steveoc:)

I hve received a letter from Barclays offering me £700 which is half of my original claim i will now send a rejection response letter saying i will acept the £700 but will continue court action until i receive the full amount and give them another 14 days a copy of the letter which i can print off this site is that the correct aproach thanks Steve

The 14 days Could some are now up and Barclays have ignored my letter asking for the full amount they offered me £700 which was half of what i originally asked for they have now had a full 28 days to comply. Do i know start county court action or send them another letter. Could some one point out on the site where i can find the information for the claims pack and how much it will cost for example if they settle out of court do you lose your court fee any information much appreciated.

You need to start a court claim now if as you say you have sent a Prelim and a LBA. They offerred me £700 as a first offer, then when I refused never heard anything so filed a claim. My first claim was for charges for £1315 and they eventually settled for £1950.73. after adding stat interest and fees for court and AQ. Then file a claim using either MCOL (Money claim online) heres the link: Her Majesty's Courts Service

 

Or use the N1 form and file it at your local county court with the fee. This is my preferred route as you have more room for your Particulars of Claim (POC). Thanks agin Tans i did send a rejection of setlement offer letter that is the one that was ignored. just another question who works out the interest do i have to do it or do the court do this , and how do i do this thanks again Steve.

Which interest are you referring to? If your referring to the daily rate interest, then just x by number of days since you filed to give a total and then when they contact you to settle, state it needs to be included before you accept.

 

Other interest you should have added by working this out using a spreadsheet found in the library section (which I'm sure you did).

No i am afraid i have not calculated any interest as yet i have seen a figure of 8% mentioned what is this is this interest on the total claimed or interest since the claim sorry if i seem a bit dim over this aspect Steve thanks again
