I am claiming £301.29 from MBNA and have sent my LBA and got the usual reply that they are in the right etc etc, but also this -

'I note from our records that as a courtesy a partial settlement was accepted on your accounts. When calculating the settlement amount any fees that had acrued on your accounts are removed, therefore there are no fees to be refunded'

I had 2 cards with MBNA and agreed a settlement figure with them for both and paid to get them off my back.

Have anyone had this before and what do you think i should do.

I set them a letter saying that i had had no notice of this and that i wanted proof that this had been done. I gave them 3 weeks to reply and so far have had nothing back. So i sent another letter giving them 2 more weeks and if nothing received by then, i would consider taking it to small claims.

Has anyone come accross this before and what do you think my next step should be ?

Have sent 2 letters to MBNA and they have not replied to either of them.

Next step, to take it to small claims court, which i will be doing this week.

Have you had any response from them at all since they replied to your S.A.R - (Subject Access Request)?

No response at all

And did you accept the partial settlement in writing?

They have not offered me any payment, so i have not accepted any partial sett,

The sett i agreed to was a figure to close the account.

Papers ready to file in court tomorrow. Maybe they will reply to this instead !!!
