Haven Bank Retail Park Exeter - parking charge

We have received a parking charge from SMART PARKING for £90 or £54 if paid within 14 days. 

 

The letter shows a photo of our car entering the car park and exiting site.

The offence date was on 23rd April with the letter dated 06 May.

I received the letter today 09 May. 

We are customers at the bowling alley.

We must have missed the parking signboard.

 

Is there a way to appeal or contest these charges as the amount is too excessive?

Fill the forum sticky information in as I think that's out of time to create keeper liability.

 

In the meantime do nothing, do not contact the PPC, all you have is a speculative invoice, it's not a fine and can only end up in court if the PPC decides to chance their arm and that's fairly rare these days.

 

What is the alleged breach of their silly made up rules that you have supposed to have committed?

For PCN's received through the post [ANPR camera capture] 

(must be received within 14 days from the Incident)

 

Please answer the following questions.

 

1 Date of the infringement - 23 April 2022

 

2 Date on the NTK [this must have been received within 14 days from the 'offence' date] Date on the letter was 6 May 2022

 

3 Date received - 9 May 2022 (by post)
 

4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] NO. However, it does state, "Smart Parking Ltd understands that your information is confidential and subject to the Data Protection Act and we treat it with the strictest confidence. This parking charge has been issued for the reasons explained overleaf, therefore giving reasonable cause for Smart Parking Ltd to apply to the DVLA for the details of the registered keeper."
 

5 Is there any photographic evidence of the event? Yes, two images: Vehicle entering and leaving site.
 

6 Have you appealed? [Y/N?] post up your appeal] NO
 

7 Who is the parking company? Smart Parking

 

8. Where exactly [carpark name and town] Havens Bank Retail Park, Exeter
 

For either option, does it say which appeals body they operate under.

That was a very good first post-you're not so much of a newbie.

Could you please post up your PCN . I suspect it is not compliant with the Protection of Freedoms Act 2012 on probably two counts. That means that the alleged debt cannot be transferred from the driver to the keeper. As they do not know who the driver is they are a bit stuck.

However that has never stopped the scumbags from trying to get money from the keeper anyway.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
