It seems that Telewest eurobell have entered a default against me, I have an outstanding amount owed to them because of a very large bill which my children managed to run up. I have paid off £700 and still owe £400. I have not received any default notice, and I am not aware that I have given permission to pass out my data to the CRA's. I have not signed any credit agreement with them. Do I request information on a subject access request and how do I get them to remove the default?

Telewest have a clause in their terms and conditions which states that they will use and supply your inform ation:

 

To search the files of a credit reference agency, which will keep a record of that search, when you apply for service. Additionally, details of how you conduct your account may also be disclosed to the agency. This information may be used by others in assessing applications from you and members of your household.

 

So they are entitled to default you on a payment, which is what you did. However, there are certain ways in which they must go about when you do this. You would only be able to get the default removed if they did not comply with the regulations that handle the issuing of the default, as opposed to you having one as it would appear that they are entitled to do that - but the loophole may be on how they did it. Check the above forums and see how it goes.
