Hi all,

About to issue SAR to First Direct for bank charges accrued over the past 6 years. The account is now closed and we are in debt to them (loans & OD) and paying them back via a Debt Management Plan. Is it likely that they might decide to withdraw from the Debt Management Plan as soon as I start asking for my money back. i.e. start threatening me with a CCJ?

I'm in a similar position as yourself, having a debt in the form of an overdraft with FD and on A DMP through CCCS.

However, given the amount of money I'm owed in charges I'll be able to clear the debt when they pay up, and hopefully you'll be in the same position. I'm not sure how far you've got yet, but at the very least ask for the statements, especially as they don't insist on the £10 fee, and work out how much the total charges comes to and then decide if it's worth going ahead.

I'm sure your DMP provider will be able to advise you on the best route for you.

Thanks Gordon,

That's reassuring. I'll get hold of Payplan and see what they say. Worst case scenario, FD go ahead and I get a CCJ, but if they pay up my charges I'll owe them less.

Good luck with your claim

Payplan is free and completely independent of the banks. Have been brill setting up DMP, and putting budget sheet together. Have helped stop phone calls and letters from Debt collection agencies.

Hello Dubliner:

Have you started another thread as your #5 is dated December 2006?

I think I can help you, or rather offer advice based on experience.

Do you want me to post here or elsewhere?

Van
