Abused Patron Parking !!!!! Never heard of it .

 

Turns out if you leave the site where your car is parked and an attendant sees you, you are ticketed, even if you have purchased in the clients premises and leave the car park before the time has expired.

 

So read the T & Cs every-time you park.

 

Can let you know how my defence goes if anyone is interested

its called reverse trespass.

Could you give us the history of this, and how far has it gone, have they sent a Letter Of Claim And what set of fleecer's is this?

First correspondence was the second letter, which goes straight to the £100 charge.

 

I replied asking what is ”Abused Patron Parking”

 

They replied that I had left the site and could view this on the payment website. I did, it shows six photos of our car parked correctly and no evidence of anyone leaving the site.   

 

I replied that I was not sending any money.

Listed my reasons as, no first correspondence,

sent proof  of purchase,

therefore their client has no loss

,photographs show no sign of anyone leaving the site and finally our car left the car park before the two hour limit expired.

 

Now awaiting their reply

They haven't got a leg to stand on.

 

However, watch out with this letter tennis with them.  PPCs will never admit to getting it wrong and you risk telling them who the driver was.

 

Generally we just ignore the PPCs' demands unless they send a Letter Before Claim/Letter Before Action.

there is NO such thing as reverse trespass , in otherwords, they nor the land owner, anywhere in the UK cannot ever charge ANYONE FOR LEAVING A SITE, ITS NOT A PRISON CAMP

Absolutely no way they can charge anyone for leaving a site  to go to other premises especially if you have spent money there anyway any case they brought would be doomed to failure, and might lead to other woes as the attendant might have opened the door to other liabilities for the fleecer, especially if any ANPR is really CCTV and they have images of someone leaving the site they rely on in court, even attendant taking pictures would be dodgy..

hi, received a reply appeal refused(no surprise there)

receipt for purchase shows time at 15.55.Attendant recorded person leaving the site at 16.04

car left car park at 70minutes later, average time in shop that day was 31 minutes.

therefore they assume  the attendant is right.

as I appealed outside the 14 day, full amount payable.

Decision is final no further correspondence.

Totally dismissed the fact that no first letter was sent out.

Average time in store doesn’t take into account having a 20 month granddaughter with you.

included an overhead photo of the car park showing the location of the car in relation to the footpath which leaves the site,also that there are 55 signs with the T&Cs

funny that the “Driver must not leave the site” isn’t in large bold Like the 2 hours free parking is.

advice please.

What utter thickos they are.

 

We know their silly rules are made-up, but they could at least get the one you "broke" right.  Yet they haven't, the PCN has nothing on it about leaving the site.  It says you abused patron parking - which you didn't, you were a patron.

They are only making a fortune because people give in. 

 

Unless they take you to court and can somehow successfully explain how you abused patron parking although you were a patron and why they told you they had photos of you leaving the site that don't exist ... you don't have to pay a bean.

No such law to ever enforce that.

 

i bet is not on their contract they signed with the land owner as they can never enforce reverse trespass legally.

 

Who owns the land? Look on land registry site costs £3
