I Park ANPR PCN - Appealed got refused

I parked in a carpark that i have parked in before only to find they had changed companies and  the parking meters.

 

The meters were not able to take cash and i didnt have my bank card (as i had been at work) and it said pay  through the website.

 

I left the carpark but then ended up with a fine as they had me on camera. This was in November.

 

I have filled out several appeal forms on their website and wrote letter, but they are still saying i owe the fine and ignoring my explanations of what happened.

 

They have now added chargers aswell.

 

What do i do next.

If it's a private car park then it isn't a FINE, only the local authorities and Police can issue fines.

 

Who is the parking company and what did you say in your appeal letter, did you give them your name as the driver?

Correction Bazooka Boo, you are correct that PPC's cannot issue a Fine, but neither police, nor local authority can issue a fine either. It is only a Criminal Court that can. The Police can issue Fixed Penalty Notices and local authorities Penalty Charge Notices. These do have the force of law as failure to pay can result in court appearance.

next time never appeal as you remove your protection under POFA2012 because most out themselves as the driver...oppss!!

 

you were there less than 10mins, there is a rule of a minimum of 10mins grace they must abide by.

That is opposed to a Penalty Charge Notice. Yours is a speculative invoice not a fine. And because the majority of large parking companies have had it good for so long, they think they can cheat and lie as well as add ridiculous costs on to what is often a minor fault by the motorist. 

 

Sadly many motorists pay these crooks but those who challenge their charges can avoid having to pay anything. So well done for coming here and not paying. 

 

In order to help you, we do need some information from you in order to give you best advice on how to fight back. 

 

Two things-

1] please complete the questions that Dx provided on post 5.  If you are having a problem with the questions please let us know what the problem is and we can assist.

 

2] you will receive many letters from unregulated debt collectors who will threaten all sorts of things and increase their spurious charges against you.

 

Do not worry about them they have less power than a dead donkey and can do absolutely nothing to you other than send letters that are designed to frighten you into paying something you probably don't owe.

 

Eventually when you don't respond, they get upset and to try to make amends by reducing the amount they were asking for originally.

 

The new figure will still be too much so you can keep ignoring them. This usually upsets them so much that they give up writing to you . They get hurt when you don't want to make friends with them poor dears.
