Hi,

my wife has been working for a Company for around 5 months and recently due to a minor issue with new working hours being given to all staff on the same contract she felt that she wasn’t being treated equally.

 

Meetings had taken place with the other workers to see if the new hours were acceptable but no meeting was held with my wife asking the same nor had there been any request to meet to discuss the hours with the supervisor.

 

Another worker who is in a relationship with the MD provoked my wife by questioning her about the hours being changed to which she told them she wasn’t happy with the change. This person is given the best work times by the MD even though other workers want to do the same hours that they receive. After the incident above a message was sent to my wife saying that the MD was coming to see her in about 20 minutes.

 

During the meeting the MD attacked my wife with a raised voice and said on at least 3 occasions that she should sack her for 3 different reasons even though there had been no previous discussions or warnings saying that they were not happy with the work she was doing or how she conducted herself. In an upset and stressed state she removed herself from the situation and later was sent another message saying that they accepted her resignation even though this was not offered.

 

Do MD’s need to follow the correct processes as this feels like a disciplinary rather than a meeting due to the content. It is clear that the meeting was arranged very quickly after the earlier incident with the worker that is in a relationship with the MD and not planned as the MD later said it was.

 

Absolutely disgusted with the way this has happened and would be keen to hear from anyone with advice on raising a Formal Complaint to the Company involved.

Your wife's main problem here is that she has not been employed by this company for 2 years. In the absence of any basis on which to claim that she has been subject to unlawful discrimination, she does not have the qualifying service to bring a claim for unlawful or constructive dismissal.

Hi, the initial part is to lodge a formal complaint against the MD to the board members about misconduct by their Senior Manager as any worker that conducted themselves this way would be sacked immediately for gross misconduct.

 

At no point did my wife say that she had resigned though due to her not being in a fit state to remain at work she left, the Company have used this to manufacture her resignation.

Unless your wife is in a senior position, I have to say it's quite unlikely the board will intervene. Different if it was a company big enough to have an HR department; but in smaller organisations, internal politics are rarely worth your efforts.

 

Forget concepts of justice; the best revenge is living well. 

 

Next time, mouth shut in front of the MDs partner. They are not your friend.
