Hi everyone,My sister has been claiming jsa but recently it’s been stopped by a work adviser I don’t normally see,he saying not been doing enough to look for work but I have all my job search written down,He’s now telling to claim for universal credit straight away but will they pay me anything because of my jsa being stopped? Also the advisor has said nothing about appealing the decision to stop jsa,What’s the best thing for my sister to do?

The Job Centres would have to pass any issues to a Decision Maker who work in a different office. The decisions are not made in Job Centres.

 

And the decision making process is not quick. 

 

Sounds like your Sister has not been doing much and has not said much about work search when attending the Job Centre.  And this has been going on for quite awhile.

 

This decision can be appealed using the mandatory reconsideration process. A letter from JSA should have been posted to your Sister and this would have explaine this.

In the meantime your Sister could make a claim for Universal Credit,  rather than wait to see how long the above process takes..

my sister has always kept written proof of her job search, This work coach seems really strict ,it’s not her usual work coach, the work coach she usually has always been happy with her job search.

 

She had her appointment with him on Tuesday 25th and he said it will go to decision maker then he called this morning and said it’s been disallowed and she needs to claim UC,

 

He didn’t mention anything about appealing the decision so my sister went to the job centre to see him and he was saying there’s no appeal phone number and what are you appealing for

 

,he was really awkward about it,

Didn't want to give the number to appeal,

something doesn’t feel right,

he said I will do the appeal for you 

 

my sister got home and rang the benefits number and even the lady on the phone was confused after checking the claim

,Dont think it mentioned anything about jsa being stopped,

she emailed jobcentre now my sister waiting for a call back on Monday

 

Also if jsa has been stopped will my sister be able to claim UC and get payments?

Won’t they say jsa is stopped you can’t claim UC?

Does not sound correct.  Job Centres don't stop payments. Only decision makers can apply sanctions and they formally issue their decisions by letter for JSA.

 

See what the call on Monday says and go from there. I would suggest not claiming UC until exact position is known.

sister just got a call from jobcentre and the lady said she need to claim UC

Sister said ok but she wants to appeal the sanction and they don’t want to help her appeal

just kept saying you need to claim UC and kept saying don’t understand why you’re not signing up for UC

 

my sister said she don’t think it’s right about the sanction and wants to appeal.

It’s very strange they don’t seem to want her to appeal and said appeal in writing,

they’ve given no letter about the sanction,

What’s best to do next?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

If it was New style JSA that is only valid for 6 months and then they have to claim UC.

 

Most Job Centres have very few income based JSA claims left, as people are now claiming UC.

 

If a decision has been made to end income based JSA, then you need to ask for a copy of the decision letter.   Then apply for mandatory reconsideration

So agree, Claim UC and also apply for mandatory reconsideration, if there is a reason for wanting to stay on JSA.
