Hi to everyone. I've just joined the site after another slew of bankcharges by the Halifax which sent me spiraling further into debt! I sent the letter asking for my bank statements for the last 6 years on 30th Nov, as instructed elswhere on this site, so i expect it will be a while until i get a response. I admit i'm feeling rather nervous about taking on the banks in this way but excited by the prospect of receiving several thousand pounds rebate in unfair charges if all goes well!

I would be glad for any info any members who have gone up against the Halifax could offer.

Will keep you all posted on developments as they unfold.

Its been over two weeks now since i sent my letter (and fee) requesting all my previpous bank statements for the last 6 years and no reply from the bank. I used a postal order for the £10 fee; would this cause a delay or are they just playing the waiting game?

anyone got any ideas that would be great.

They have 40 days to comply with a DPA SARs request.

 

While you are waiting, why not get to grips with the FAQs and step by step guide. Between them they will answer most of your questions.

 

Also start your own thread in the Halifax Bank forum and post any questions and progress repots there, that way we can check your progress and offer support and advice as needed.

Hi, can anyone help me out with the spreadsheet calculation. My current claim is for £3697 in unlawful bank charges. I have entered this into the spreadsheet (in templates) which calculates contractual interest.

As I have never used a spreadsheet before i am a little confused as to how it works. I plumbed in the fig above and the start date of my claim and the fiqure came out at over £5000! (im assuming this is taking the 8% intrest claculation into account?? Please could someone clarify?

You may have gone for a more complex spreadsheet than you really needed. In http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-6-interest-calculation-spreadsheets.html there are some marked 'simple', this is what I used.

 

Enter up your list of dates, charges and amounts and it calculates the 8% interest. BUT, you are not claiming any of that at this stage as your claim to the bank is simply for refund of charges. You can only claim the 'little extra' (love that phrase now!) if it reaches court and you've paid a court fee etc.

 

Until then, you are only looking at the total of charges, and if the bank offer to pay the full amount then you have to accept that. It may look nice with the 8% added on, but you may not get that far as they seem to be settling a lot quicker these days, and for the full amount of the claim.

 

The issue of 'contractual interest' is one I'm not going to comment on, there are some who beliee that the banks should be forced to pay a higher rate than 8% and I'll leave that to them to debate if they wish.

 

When you are ready to send your letter (http://www.consumeractiongroup.co.uk/forum/bank-templates-library/671-2-letter-preliminary-approach.html) you should attach a copy of the spreadsheet showing ONLY the date, details and amount of each charge, with a total at the bottom. If you leave the 8% column showing they will ignore it when they come to make an offer, or whatever action they take.

For some reason Excel stopped working on my computer, but this program recognises Excel files and works very similar.

thanks for the info. I have tried to look at the spreadsheets you mention but i am unable to open them as i dont have excel?

 

There are other versions there, although I've not tried them myself as I had Excel here. Or follow the info Didge gave.

Hi again..I've finally got to grips with the spreadsheet and it has calculated that i am indeed owed £3697 + £872 in interest over a 6 year period;this is frankly quite shocking!!! I am going to claim for the full charges plus interest.Reading other threads it seems some people do this and some don't. Could do with a little guidance asto what to do for the best?

For your preliminary letter and Letter Before Action, you just ask for the return of your charges (without interest). Should the bank not refund you 100% of your charges by the time limit on your LBA, then you file a court claim and then you can add the 8% interest that is calculated for you on the spreadsheets.

Hi everyone..now that the festive season is over the business of getting what's owed continues! Having sent the preliminary letter out on the 28th, in calculating the 14 day response time, should i take saturdays into account (as banks are open on sat) or should it be Mon-Fri only?

Can anyone advise please?..........many thanks

Most people would say 14 days is 14 days, including weekends. The courts seem to allow a day extra for the bank holiday though.

 

Allowing a couple of days for your letter to arrive probably comes to the same thing, take it as delivered on 2nd Jan and count from there.

Hi All, just a quick udate on proceedings. Halifax responded to my prelim letter with the usual rubbish ...we are sorry to hear you have a complaint and blah blah..anyway waited the 14days and then have posted out the LBA this week. I'm fully expecting to serve notice of proceedings after the 14 days are up..so its just sit tight and see what happens next!

further update. I have recieved another letter from the halifax today, ocnce again saying that "they are sorry that i havent received a full response to my complaint....and i should receive a response from them no later than 23rd Feb (from Michelle Gardner). Well by that time i will have gone throu court proceedings!! dont understand the logic of the banks as they ultimatley have to pay out more this way????

The banks just live on the small hope that you haven't prepared yourself by reading this forum thoroughly and will take what they tell you in their letters, give up and take a lesser settlement.

 

But you know you have ;)

Best of luck! I'm still waiting for my statements....got a letter on 26th saying they're on their way! How exciting! I have NO idea how much my charges will equal...could be £1000, could be £3000...!! I know I got £360 in one month once...grrrrr...
