Letter received 8 Jan 2008

 

"Thank you for your letter dated....... I am sorry that we have not been able to respond to you and ask that you bear with us. We are currently investigating etc etc - Signed Sandy Wall"

 

Fax sent advising that proceedings will be lodged at court on Monday.

Small point Shoekid.....Just because your charges exceed the small claims limit, no point in you losing out on the extra 200 odd quid. If you are making two claims - one for the charges one for the interest, just add the extra charges to your second claim. If you split your claim in two, lets say for example 2001-2003 and 2004-2006 (or however so that both claims are under £5k) you can get everything back.

My claim is as follows

 

Referral Fees = £2230, Interest @ 8% = £668.31, Total £2898.31

Unpaid / misuse fees = £2840, Interest @ 8 % =£757.93, Total £3597.93

 

Total £5070 + £1426.24 = £6496.25 + Court Costs

 

Shall I do the following

 

1. Split the claims as above to get allocated to Small claims

2. Just bang in one claim and go for fast track

 

If i split the claims can the defendant apply to join them as a single claim?

Small point re the 8%, you haven't added this to your prelim you sent have you?? This is only supposed to be added once you file a court claim (just checking ;)).

The obvious benefit of small claims is not being liable for anything should you not win the case which effectively shouldn't happen (providing you do everything properly) because the banks will have settled before then.

 

One other point, if you do end up splitting it, I wouldn't split it by type of fees - I would split it by a date period a this will be far easier for other's (ie the courts) to review. This is of course jmo, so you do what you want :D

Accepted.

Did you end up filing court papers? Is that why they settled??
