What is the claim for –

 

1. The defendant is indebted to the claimant for a parking charge issued to vehicle **** *** at ******************.

 

2.The PCN details are 15/01/2017, *****************. The PCN was issued on private land  owned or managed by the claimant. The vehicle was parked in breach of the Terms on Cs signs (the contract), thus incurring the PCN.

 

3.The driver agreed to pay within 28 days but did not. Defendant is liable as the driver or keeper. Despite requests, the PCN is outstanding.

 

4.The contract entitles claimant to damages. 

AND THE CLAIMANT CLAIMS

£160 being total of the PCN(s) and damages. Interest at a rate of 8% per annum pursuant to s.69 of the county courts Act 1984 from the date hereof at a daily rate of £0.02 until judgement or sooner payment.

In my last thread it was Gladstone’s who were dealing with 2 pcn’s but now this is DCB Legal who are dealing with this third pcn that I had no clue about.

 

DCB wrote a Letter of Claim on 4th November and I presumed they were writing about the other 2 pcns as I thought Gladstone’s had sold the debt to new legal company so I ignored it.

I don't suppose you have the PCN that was issued back in 2017? if yes please post it up. Things must be bad with UKPC if they are swapping Gladstones for DCBL. Tweedledee and Tweedledum could do a better job than either of these two companies who laughingly refer to themselves as solicitors.

 

Can you not scan the Letter of Claim.? If you read the letter it will explain when to provide a defence and the AOS.

Hello,  no I don’t have the PCN from 2017 I don’t live at the old address since jan 2018 and can’t remember it at all. The letter of claim I will re upload and delete the personal details and then I will add the court claim. 
 

I know from a bit of research last night I have to complete my AOS but do not know what to plead or how to deal with my defence at all. Thank you for your help

But you know how to complete the AOS? It's in the sticky about claimforms that you did yesterday/

 

Your defence isn't due immediately, you just need to let the court know that you're defending this.

Yes read the sticky and I am going to do my AOS today and put defending myself. Then I have to prepare my case. That is what I need all the help with. I never done a SAR with this pcn or remember any paperwork I might of got for it at all, it was 5 years ago nearly so can’t remember at all.

Enter your email address where asked.
You will now be emailed a confirmation code. ...

You will now be issued with a User ID for your government gateway account.
 note down your details inc the long gateway number given, you might need it later.
 

then log in to the MCOL Website

select respond to a claim and select the start AOS box.

then using the details required from the claimform

defend all

leave jurisdiction unticked.

click thru to the end

confirm and exit MCOL.

Hello it was either in one of the bays out the front or underneath the flats where there are a set of gates where I got the pcn.

You were visiting someone living in the flats?

 

this will i expect is a classic case of a vanishing windscreen ticket? (As you didnt find one on the car at the time?) As thats what ukpc are masters at. They usually pay back handers to a local resident to take photos of offenders and dob them in to ukpc. Thats totally illegal.

 

the paperwork will be very interesting and i bet they'll try and fake it and i bet youll find the ntk will be dated within 29 days of the 'event'

I honestly can’t even remember it was so long ago and I use to live in the flats though that’s why I parked there.

 

I remember getting a ticket once for parking in a wrong bay but that was because someone had parked in my bay and I had 2 kids and was pregnant so parked in another bay as I wasn’t well at the time.

 

I got another one for parking in my bay and not displaying a permit but I don’t know which this ticket could be for? 

 

Both tickets I got I ignored.

great so you were a resident and would have had allocated parking i expect do have supremacy of contract, this should be easy.

par chance you dont happen to know anyone that still lives there do you?

see if you can get them to copy/send/check their deeds and tenancy agreement

i bet parking is mentioned so you would have supremacy of contract.

 

do you remember if you were allocated parking or got passes or whatever?

I have responses to the AOS on the MCOL website and got confirmation.

 

I am sending the letter to the solicitors I typed up tomorrow.

Should I send as recorded first class or just first class free proof of postage?

 

I’m trying to get a copy of my tenancy agreement or one of my old neighbours.

In the meantime is there anything else I need to do to start my defence? 
 

will I have to go to court?

My anxiety and panic attacks are so bad I can’t even think about going to a court room right now

what you think court is like is not what you think as per TV etc, its very informal, just like a table meeting in a way.

 

defence is due by day 33 from the claimform date ..go work that out as advised twice now

9th of Jan it’s due which is a Sunday so guessing the Friday before which is the 7th Jan and that’s counting al the Christmas Ana Boxing Day dates. I’ll have a look on the thread and put the defence together now

But you'd do far better in using the time till 10th (you get one extra day due to xmas/ new year) to read a good few 10's of pcn claimform threads here so you understand WHY you are stating what you will file.

I’ve done some reading last night and this morning and have the following to use in my defence.

 

Signage - It’s hard because I’m not sure where my car was parked as to what angle I need to take photos of the signage and it was back in 2017 so may have changed and been updated since then? I remember a sign was graffitied on once and was very unclear to read 

 

I was pregnant and in January was suffering with awful sickness and migraines. 
 

The parking was on private land and having requested this information have nothing received the proof?

Your main thrust will be supremacy of contract, but that might only come into play  at disclosures stage.

1. The location in which I received this Private Parking Notice is Private Land that Swan Housing Association own, and I paid rent to at the time.

 

2. I was pregnant at the time of the PCN with my third child, born 03/07/2017, I was also looking after my 2 other children. I was of high risk pregnancy which involved me having more frequent hospital appointments due to high blood pressure and migraines. I do not remember any PCN being attached to my windscreen that’s was in relation to this PCN.

 

3. The signs within the car park were regularly graffitied on and vandalised.

 

4. The claimants notices attempt to make a forbidding offer, which isn’t an offer at all; therefore no contract exists.

 

5. There can be no legitimate interest in issuing charges to residents, as the parking scheme is aimed at external ‘abusers’
