    • They have defended the claim by saying that the job was of unsatisfactory standard and they had to call another carpenter to remedy. My husband has text messages about them losing the keys a second time and also an email. What do they hope to achieve??? Most importantly,  as far as I have seen online, now I need to wait for paperwork from the court, correct?
    • The Notice to Hirer does not comply with the protection of Freedoms Act 2012 Schedule  4 . This is before I ask if Europarks have sent you a copy of the PCN they sent to Arval along with a copy of the hire agreement et. if they haven't done that either you are totally in the clear and have nothing to worry about and nothing to pay. The PCN they have sent you is supposed to be paid by you according to the Act within 21 days. The chucklebuts have stated 28 days which is the time that motorists have to pay. Such a basic and simple thing . The Act came out in 2012 and still they cannot get it right which is very good news for you. Sadly there is no point in telling them- they won't accept it because they lose their chance to make any money out of you. they are hoping that by writing to you demanding money plus sending in their  unregulated debt collectors and sixth rate solicitors that you might be so frightened as to pay them money so that you can sleep at night. Don't be surprised if some of their letters are done in coloured crayons-that's the sort of  level of people you will be dealing with. Makes great bedding for the rabbits though. Euro tend not to be that litigious but while you can safely ignore the debt collectors just keep an eye out for a possible Letter of Claim. They are pretty rare but musn't be ignored. Let us know so that you can send a suitably snotty letter to them showing that you are not afraid of them and are happy to go to Court as you like winning.  
    • They did reply to my defence stating it would fail and enclosed copies of NOA, DN Term letter and account statements. All copies of T&C's that could be reconstructions and the IP address on there resolves to the town where MBNA offices are, not my location

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Got this letter this morning:

 

Dear Sir,

We refer to your letter dated 19th march 2007.

 

Abbey National PLC is prepared, without admission of liability, to accept your counter offer.

 

payment will be made in the sum of £1550.00 in full and final settlement of your claim.

 

Upon receipt of the settlement monies please write to the Court withdrawing your claim and provide to us a copy of your letter.

 

Yours Faithfully,

So thats it..... I won. I still cant believe it. I thought for sure id have to end up submitting a court bundle.

I've just read your thread from the beginning, (rather than flip to the last post and then work back to where I'd read to before!) so, there were bits that I've read them before, but I'm glad I read it all the way through because it has a good ending!

 

My husband was beginning to get cold feet over the whole thing this morning (good job it's not him doing the claim!) so I'll show him this to show him that it'll be worth it in the end!

Thanks for all your congratulations.I know its not a lot of money compared to some peoples claims but its gonna really help us on our way. these charges made life hell for us when we had our son last yr and created an almost impossible situation to live in. we had to move 200 miles away for a cheaper place to live (from London) to just survive so am very pleased that we've been able to recover this money and now we can concentrate on putting it to good use.

Hi all, not sure if this is the right place to post this but here goes, and yes I have read your FAQs.

 

I am claiming £775 from the Abbey and I sent off my first letter plus £10 cheque on 2nd Feb `07, I received a standard letter of reply informing me that the statements etc where being processed and with me within 7/10 days, they were in fact with me by the 27th Feb `07.

I sent off my second letter with my request for repayment on 28th Feb `07

 

"The charges total £775.50 . I believe I have been unlawfully deprived of the money and therefore ask that you repay me the full amount. Please find a full schedule of the charges with this document.

I look forward for a full response to this letter within 14 days."

 

I received a standard letter written by the Abbey on 17th March 07 stating that they were sorry I was so unhappy I felt I must complain etc etc and that they are investigating etc etc and enclosed a complaints leaflet which advised up to 8 weeks to deal with !!

 

Do I just sit and wait? I have looked for information regarding the rejection of the 8 week rule but cannot find, any advise please?:?

Can you let me know how long it took for you to get a reply after you filled your court claim? I just done my MCOL this morning and don't have much patients when it comes to waiting on other people. I started the ball rolling in January, suppose i have to just wait and see. It will be worth it in the end to get the money back that they unlawfully took.

 

Any help would be much appreciated lol and CONGRATULATIONS on your win, hopefully i will be a winner as well. :D

Tinks, I am so so impressed with your thread - I have read it from beginning to end! I was beginning to get cold feet myself having submitted my MCOL claim only a short while ago and the Shabbey blighters have decided to defend. You and the people who have responded to your posts have given me renewed hope to carry on. Well done on a splendid victory xxx

Just seen ur msg.They acknowledged my mcol about 5 days after filing and entered their defence on the last day. About 2 days later i received my allocation questionnaire and letter from abbey offering half. about a week and a half after filing allocation questionnaire I got mystandard order for stay.

i have had letter about tranfer of court but there was no allocation questionnaire it was crossed out i have been told by few members on here that the courts are getting pxxxxxed of with the banks delaying things and that it speeds up process so fingers crossed i can get a settlement soon claiming £1500

Thanks for that. I'm getting a bit nervous and excited now, don't really want to have to go to court but needs must. Did you claim back the £9.25 an hour for the time it took you? if so, how many hours did you put in and did you cliam anything else?

I have worked it to be roughly 1.5 hours a week from the start (which was in January)

Congratulations tink, when I sent my offer of settlement I signed it instead of my husband (who's name the claim is in) so they sent a funny letter back about it being signed by a woman etc. Anyway I sent them another copy of letter signed by my hisband and I've heard nothing back. Was wandering what exactly did you put in section G of AQ and what exactly did you send back to the court with it?? I've just releaised that I may have re'd the AQ over 14 days ago would I get a letter off the court if it had been struck out does anybody know?? Getting stressed now, want it all to end but I'm still going to fight. xxx

No Not Got My Own Thread I Have Spoken To Court Today Who Have Sent The Aq Out In Post But Still Not Received It I Have Left Message On Answer Phone Of James Arrandale To See If They Want To Try To Settle Out Of Court But No Response Yet Have Sent Letter Today To Say No Aq Attached With Court Docs As Well To Them See If I Can Rush Them To Settle
