    • Hi   I know this is a difficult time for a lot of Business owners due to the Pandemic and am sorry you are now in this situation.   Did the Courts appoint the Insolvency Practitioner?   Is the Insolvency Practitioner aware of the NatWest Business Loan and that it is with a Personal Guarantee? (if not you need to inform the Insolvency Practitioner)   Was the NatWest Business Loan with your Personal Guarantee signed as you being Director of that Company?   Are you able to keep up the Repayments for this Business Loan with Personal Guarantee?   As this is a Personal Guarantee for a Business loan which would more than likely have been signed with you as in the position of Director of the Company (correct me if I am wrong) This is you making a Legal Agreement as director who is liable for paying that debt and in this case as the Business in now going through Insolvency Proceeding.   The consequences for yourself depend on the actions of NatWest and if you can't keep up their repayments as your Business is going through Insolvency, NatWest could enforce that Personal Guarantee to recoup their money by going after your personal assets which could be at risk (not business assets) as this was a Personal Guarantee so you need to be fully aware of that. (it would also depend on the wording in that Personal Guarantee you signed)   You need to fully read that Personal Guarantee that you signed with NatWest to understand that actions they can take to recoup that money
    • Hi Stu007,   Tyvm for your message. I have tried to change doctors a few times over the last few years, but my doctors doesn't allow it for some reason.   As for the way he speaks to me, I have thought about putting a complaint in against him in the past because of his attitude, but decided against it as he would probably treat me even worse.     • Hi   I see no reason posting a Redacted copy (in PDF Format) will affect you with Mears as to give the proper advice you seek especially since you have sent them a Letter Before Action (LBA) you should be fully aware that your next action Court Action to resolve this if they fail to reply or reply and dispute your claims.   Without the above (as so far you have only given us very small parts of this agreement) it is going to be difficult to advise.   Have you sent them the Subject Access Request (SAR) that I also advised?    
    • ive merged your threads can i just confirm you thus have 2 outstanding business loans one with natwest one with the funding circle   and both you know you signed personal guarantees as well as the std loan paperwork as a business?  
    • Nar, don't bother.   I'm sure your daughter will have no problem in producing a long legal document called a Witness Statement and then appearing in court to defend the claim while having absolutely no knowledge whatsoever about what the claim is about.  It'll be a doddle for her.    Why bother sending off a simple template letter with 95% of it already filled in after being told on four separate occasions by the forum to do so, when you can continue twiddling your thumbs and end up getting thrashed in court.

Hello all,

 

I'm about to embark on recovering money owed within the last two months while I have been struggling a bit with money.

 

I have been into my local branch and asked about all these charges being made and how they can justify (for example an £8 unpaid DD charged at £28).

 

The branch manager blabbed on about reading condition of my account etc.. and that she could not refund the money.

 

So I need a little guidence...

 

1. I will send the Preliminary letter to the bank (do I send to my local or head office?)

 

2. After 14 days I will send the LBA letter.

 

3. To start court proceding I will need help on how to go about it.. I have read the faw's etc but I'm not sure where to go.

 

Please Help with my steps... Once I know precedence of actions I will be fine..

You can send the SAR to your branch.

yes send the LBA after 14 days

Read the step by step instructions for guidance on your whole claim and also read halifax threads.

Send them to your local branch, you will be informed if they want any future correspondance to be sent to a different address.

Just waiting for another "Penalty to come out tomorrow as inform through a letter last week then I will collect them all together and send the preliminary letter by friday.

Right, I have finally started the procedure. I sent for the statements and received them just over the 40 days limit. I have been through the statements and found charges. Do I also include "interest debited" Charges?

Enter all the details into one of the spreadsheets

You are able to reclaim the proportion of interest debited which has been applied due to the unlawful charges, sounds complicated but if you enter all the relevant details into one of the spreadsheets it will do the calculations for you.

hi im new to this but applied and sent second letter to my bank saying they had 14days untill i apply to the court, 14days has past 2day no letter from the bank do i leave it to the end of the week or just go for it as on limmited funds myself can you let me know as im dealling with halifax myself thank you

Hello, I really need some adice now.... I have started court proceding with MCOL and now have to wait until 17th July for the 5days action plus 14days required time before I can win by default.... I'm a bit worried now concerning what to do if I do end up going to court.... They may have a fancy talking lawyer and I'm just a humble person wanting my money back with no law background... I have downloaded the court bundle pack and have gathered all the information together. I also have read the pack but obviously it's way over my head... Please advise what I really need to know to win... Thanks

Hello all,

Had a letter from the courts acknowledging the counter claim from the bank...

 

When I got home I had a letter from Halifax Customer Services saying they will pay the WHOLE ammount into my account within 5 days after which I will drop the claim....

 

I WON THE BANK...... YES!!!

 

MY ADVICE TO OTHERS......

 

STICK TO THE PROCEDURES...

BE PATIENT....

DON'T WORRY.....

 

AND YOU'LL WIN.....
