Idem now Hoist Finance pursuing an old Halifax credit card debt

Hi,

 

I had a credit card from the Halifax which after I lost my job,

I was paying £20 per month after discussing a lower payment.

This then went to Blair Oliver Scott and I kept paying.

 

After it went to Idem in May this year I stopped paying as I didn't think they had a right to collect.

 

They hassled me by phone ringing every day sometimes twice a day and I ignored them, partly because I am deaf and couldn't hear my phone.

 

now I have Westcot chasing me.

Can you please give me some advice?

Do I now have to pay Westcot?

Are they likely to take me to court?

Or shall I ignore them as well?

 

I don't know who will pursue me for this next maybe Kentucky Fried Chicken!

Wetcloths dont buy debts only chase for their client who is the only one that can do court..the owner of the debt.

 

You should never ever talk on the phone about your debts

A dca is not a bailiff

And have ZERO legal powers

 

When did you take this out?

Who will be chasing me Idem?

 

Do I have to start to pay them?

And are they likely to take me to court?

 

Sorry I think I CCA'd Idem and they sent the £1 back.

The card was taken out on 2001

you've been here for +10yrs

you've won several court claims yet you seen to fall down on doing the basics to protect yourself from these fleecers.

I CCA'd Idem in March they sent the postal order back and said that they would get the information I required, pestered me to death and now enter Westcot.

 

Yes you're right I have been intermittently on here for a long period of time and I have followed the advice given. I am not a regular visitor as I am currently sick and still receiving treatment after several operations.

 

I'm sorry if I have offended or annoyed you. I have managed to win a couple of claims thanks to this site yes, but each one involved different players Idem and Westcot are totally new to me and I can't keep pace with these clowns if I don't know who they are and what their powers are.

you wont annoy me non at all I enjoy getting people out of the powerless DCA milking parlour

and even more preventing them from getting their hands on peoples money when they have zero legal right it.

all they do is use it to pay for staff holidays and free drinks allround

as well as things like this

Hello,

I have received letters from Hoist Finance about an old Halifax card.

 

I last paid anything in 2018 to a credit company, before it was claimed by so many debt companies, I didn't know if KFC had considered buying it.

 

Then up pops Hoist. I said the account was in dispute and to send me something linking it to me ie with my name.

 

Saturday I received a letter saying they had halted any action.

 

This morning I received a letter showing all transactions and my signature dated 2005. I am a pensioner with very little income now, so any payment needed would be minimal.

 

Nothing is showing on my credit account and I have rebuilt my credit score.

 

Do I have to interact with Hoist?

Can they take it to court?

 

Please advice me as to how I should carry on with this.

I didn't know Idem was now Hoist. It's the same old circus then.

 

Should say they threatened to send someone round to my house but stopped action when I disputed the claim.

I am afraid they will send someone to my house as I am nearly housebound I'm in all the time and I can't face these people off.

 

Sorry to be a nuisance, my memory is not as good as it once was, but what is the reason this "debt" doesn't show on my credit report?

i haven't said idem are hoist?

hoist have purchased quite a few portfolios of very old debts from idem as idem got fined by the authorities awhile back and went very quiet for a long while as they were misleading debtors on many fronts even in court cases.

 

as for the debt not showing, it won't , the original creditors default notice has obviously exceeded it's 6th birthday. when that happens a debt is removed from your file.

 

The Information Commissioners Office says:
.
All references to a defaulted debt must be removed from your credit files after 6 years 
has passed from date of default, whether paid off, paying now or not. 
.
{the WHOLE ACCOUNT WILL VANISH, never to return}.
.
{however, this does not mean the debt itself is not still owed
consider a CCA request.}
.
This is so that someone who continues paying something 
- even after 6 years from default 
- should not be at a disadvantage to someone who pays nothing after default 
and ends up with a clean file after 6 years. 
.

I will upload the stuff today. The first page is a photocopy of my Personal details from Halifax. Page 2 is terms and conditions with my signature dated 26/01/2006 and the rest are statements not on Halifax paper, ie no logo just type,  dated from 02/02/2006-02/12/2008. The statements are not worth sending them all but will send one to show you what I mean.

there are several pages missing as well as the T&C which must have your correct address for the time of take out on them.

 

pers as long as hoist have your correct and current address (if you have moved since taking that out and not informed HBOS or Idem in writing of the move) then simply ignore them until/unless you get a letter of claim.

That's all they sent after I requested that they show proof that they have  a right to pursue me. There were several pages of transactions from very early on  but that's it. I will wait and see what the CCA throws up.

today I received a letter from Hoist, all they sent was pages  1and 3 of the PDF I already uploaded with this letter. (Dated 7/12/2021 which I received today the 11/12/2021) 

 

Dear XXXX, Further to your request for a copy agreement for the above account, please find enclosed the relevant documentation for your attention.

 

Please note if an original agreement was not available, under the Consumer Credit Act a reconstituted copy may be provided.

 

If you are not already making payments towards your account, please forward your affordable payment proposals to us. We have placed your account on hold for the next 14 days, after which time collection activity will resume on the account.

Should you have any queries or concerns during this time, please do not hesitate to contact is on 03452668876 or alternatively you can email us.

they now have your correct and current address from the CCa request and have written back, so backdoor CCJ prevented.

 

simply follow the above .
