hello 

 

I have had a letter from Kearns Solicitors - it is a Letter of Claim.  I need to respond in the next couple of days as I stuffed this in a drawer :-(

 

The letter is dated is 20th October and gives me 30 days... 

 

its £8k claim from MBNA - and I cannot afford to pay it off. 

 

They have sent me an I&E Form and a reply form. 

 

Can anyone please give me any advice on this please?

the one you posted dated 15 Oct?

 

do you think i should dispute the debt in the first instance?

 

what reason do i give for disputing the debt? financial coercion / abuse? 

 

when requesting CCA - what section of CCA 1974 am I referring to please?

Depends what type of debt ....credit cards are section 78 fixed loan's section 77 and HP are section 79.

go carefully read post 2 of the letter of claim thread

and all the posts of the CCA request link.

 

as for the additional reason from your thread - just use the default one there already 

dont forget use the attached PDF NOT their forms they sent.
