      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hope its definitely worth an approach to Cobblers, but I dont think they will be in a hurry to settle till nearer the prelim hearing date. They only tend to spring into action once a hearing date is almost there. i.e. I bet its worth an approach to them around 7th-14th July ish. That might spring them into action, as we all know they prefer to settle, rather than go through with the telephone hearings..................... thats what I found anyway. Fendy xxxx

Because i'm not a patient gal lol , I am going to contact Nat West and tell em I've got a hearing date.

 

They may turn round and say so what ,see you in court , but on the other hand they may suprise me and say they want to settle lol !

 

I know.... a long shot but hey, nothing ventured nothing gained !

 

I would appreciate a pointer in the direction of a really good letter basically asking for settlement and pointing out it will be in the best interests of the bank as I will be filing a wasted costs order if they dont play ball !

Hi hope... you could adapt the court bundle cover letter I posted you before...

 

Something like this:

 

Dear Cobbetts,

 

As you will aware a hearing date has now been set by District Judge ******* of ******* County Court. The hearing is set for the **th of ******* at **am.

 

The total claim now stands at £*,***.**p with interest increasing daily. Please see attached Schedule of charges. This total amount is for penalty fees levied, plus compounded contractual interest, plus court fee, plus allocation fee. Unless this amount is paid in full before the **th ***** 2007, court proceedings will continue and a hearing will take place.

 

If this matter is not resolved before this date and I, the claimant, am forced to appear in court, then I shall begin proceedings for a ‘Wasted Costs Order’, where a Schedule of costs incurred and time spent will be supplied to the courts including a list of settled cases for National Westminster bank.

 

The pressure put on legitimate claimants and the court system is enormous and I shall be seeking costs in view of your abuse of the court process unless this matter is settled before the court date.

I spoke to Cobbetts along these lines myself a week ago. Useless. I told them how awful they were wasteing public money like this and the girl I spoke to said, and I quote, "its your fault for suing NatWest"!!!!! I told her it was NatWest's fault for breakingthe law!

Carry on. At the very worst they will try and negotiate you out of CI. Don't panic. Part of my claim was CI and they paid it. Every day and every claim is different.

A person is only as big as the dream they dare to live.

Its your money taken unlawfully from your account and you have a legal right to claim it back.

I have just read through the link...

 

Hmm... does seem a little worrying, but is this in a case where the bank have actually turned up for the hearing? Also... the guy (dad) had already recieved charges plus the 8%...

 

I think it is still fair to try your luck at going to court for the full amount plus contractual.. the worse that can happen is that the judge awards you the 8% instead.

 

Don't panic hope.

OH PANTS !

Just read a sticky advising that Cobbetts have moved from ship canal house.

I sent a nudging letter last week to the above address so not sure now whether to resend it to new address ?

I would imagine that Cobbetts will have some kind of mail re-direction in place but would like to know if they actually got my letter.

 

Does anyone have an email contact for Cobbetts please ?

Hmm... I've been thinking the same thing about Cobbetts and the move of their office. I haven't heard a peeop since I sent in my court bundle... my date is 16th July and so it is all getting pretty near.

 

Do you have a number for them hope?

 

Did you phone them to see if they recieved your letter?

I did call them and got some sort of feedback as to what's going on with my two Nastwest claims. Hopefully I will be getting another offer for the bank account claim... Fingers crossed.

 

I also asked them about the change of address. Their new address is: Cobblers, 58 Moseley Street, Manchester, M2 3HZ... and I asked about mail sent to Ship canal House. She told me that all mail is re-directed. Phew!!

Hi :)

 

I'M A WINNER !!!!!:):D

The total amount of the settlement is £4022.40. This breakes down as £2160 in charges, £401 in stat 8% int, £220 in court fees.......and the rest in contractual interest at 16.74% !

It actually works out a bit more than the 16.74% but i'm not picking hairs here !

 

So, a good result all round.The cheque is in the bank !

 

So, guys. I still think it's worth holding out for the CI element of your claim if you are sure you know what you are doing. There were times when I doubted I would ever get settlement,and it really did get close to a hearing.,with it being listed for 7th Aug.

I must admit though that I was determined to go all the way with this, regardless of how it panned out,and I think that the staff at Cobbetts knew this.

I have to say that both FC and AM at Cobbetts were very nice and professional,at the end of the day they have a job to do, so ladies ,if you are reading my thread,thanks for the way you dealt with me .

 

So,that's round 1 completed.

Going to start round 2 soon, which is NW creditcard and re-claiming from 1990-2000.

 

Good luck peeps and stick with it.
