    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?
    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Wonder what your advice would be given the documents they have provided? I am now in a position to clear the debt either by lump sum or a few large installments - Is this something i should look into at this late stage? Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This bit is very boring... and I am dreading printing all the bundle of paperwork off for court 'cos it's such a waste of paper and no-one will probably even look at it.

UPDATE:D

My cosmic ordering worked(sort of !)

 

Recieved a cheque from Cobblers this morning for £2561.26 which equates to £2106 charges plus 8% .

 

My claim is for charges plus contractual interest , a total of £4329.24 so a bit of a shortfall there !

 

I guess I have to send it back along with a letter. I think there is a template/copy letter for this purpose but cant remember where I saw it. Would somone please post me a link if they know where it is lol !

 

They also state in their letter about not disclosing any details to 3rd parties etc which I obviously wont agree to as its a bit late for that.

 

Any help muchly appreciated as always guys

Mmmmm.Stressing out a bit here....

I've been reading through various threads and I feel a little uncertain now as to what I should do.

As you know ,I have given NW ample time and chances to settle before court stage and they refused to pay any interest.

They have now offered in full for charges and 8% stat int,which leaves me short on my full claim as I have claimed for contractual from the outset.

The general consensus was if the charges and 8% had been offered, then it had to be accepted as it was basically a full settlement,and this is the advice that has been given by mods etc in the past.

 

Is this still the way to go ?

Would I be foolish to decline the offer I got today(she says,stroking the cheque for £2561.26 lol !:o )

 

I would be prepared to fight this in court if it came to it. All I want is to be in the position I was in before Nat West applied charges to my account.

 

I would appreciate some input from a mod/site helper on this please if one is around for comment ?

Hi Hope,

 

The question of whether you want to continue is how confident you feel that you could argue the legal basis for contractual interest in court. This requires a good knowledge of trust law and restitution law and the divided opinion among academics and the judiciary on the concept of a remedial constructive trust.

 

Even if you are fully conversant in this area you then take your chances as to getting a judge who is on the restitutionary side of the debate rather than the trust lawyer side of the debate.

 

Even if the judge is sympathetic to the restitutionary arguments it still comes down to their dicretion as to whether in the circumstances of the case an award of compound interest at the contractual rate is necessary to do justice.

 

The odds are a little stacked against you. If you do forceit into court by rejecting the offer. You risk being liable for their legal costs if the judge is minded that you acted unreasoanbly in refusing their offer.

 

Ultimately the choice is yours

My position is this.. They still owe me the costs cheque. And they still haven't resinded the confidentiality clause. Both of these i believe are strong enough to go into court on...

 

However, if both of these are settled then i will not proceed any further...

I'ts a difficult one alright. My instinct tells me to ride the storm and decline the offer, as it is unlikely that NW will go to court with this. They have much more to lose than me, and I have asked in my drafts direction order that they basically need to disclose how they calculated the charges etc.Hopefully this would be enough to dissuade them in going to court ?

 

I'm still not sure which way to go.

 

Has anyone actually been into court to argue the contractual interest yet, whilst their claim is intact ?

 

Would I be able to bring the disproportinate charges up or will this be disregarded as NW are not disputing paying the charges, just the contracual interest element ?

The actual court process doesnt worry me as I have recently been to court twice re charging order and ccj set aside, but I learnt that only the matter in hand could be dealt with and everything else is imaterial to the case.

It would just be the contractual interest element and this will be even more difficult to prove if you are not able to show that the charges were taken unlawfully as this would mean that the claim would lack the element of unconscionable behaviour for imposition of a trust.

Difficult to say in relation to bank charges. They few mortgage cases which lost in court had to pay between 4.5-7K

a differcult decision to make,no one can really advise u on this as its really your decision and your decision only........

 

I cant see anyone advising u 2 go to court as no one really knows what the outcome will be........ i agree that the banks willnot have to disclose costs as they have settled that side of your claim...........

 

So the only argument I can see is the CI, they will pay the stat 8% but will they risk a court case with CI ???????????

 

I would love to see someone go the whole hog with the ci claim as im waiting along with many others to claim CI,the rewards are huge if someone wins but on the other hand the cost implication are also high if u lose.............

He says that as I will be arguing the CI in court regardless of whether I reject the gogw payment or cash it.

 

So,on this proviso he thinks that I should accept the payment as part settlement and carry on for the rest.

 

I dont normally listen to a word he says !. But i'm torn....

I asked in an earlier post if anyone had actually been into court with a CI claim,but havent had a response either way as yet.

I have slept on it and my descision is made

 

I have decided to reject the offer and continue in my fight for CI.

 

If I win great ! If I lose that is something I will have to deal with if and when I get to that point.

 

Thanks for the recent input on my thread to zoot,scott etc, to make a choice I believe you have to be aware of all eventualities.

 

I will now spend the time I have before court cramming up on everything of relevance in my fight for CI.

I have just draughted my final letter to Cobbetts declining their offer and telling them to basically stick their conditions where the sun don't shine lol !

 

I would love to take credit for the fantastic wording in my letter, but all the credit is due to Mindzai and his wonderful use of the English language.

I have ajusted bits of text to suit my circumstances, and left out the bits that don't relate to my claim, but on the whole it is the letter that Mindzai sent to Lloyds.

 

Pure class in a no-nonsense format.

Good for you and I back you hun. Their conditions make it unacceptable in my opinion. NO CONDITIONS!!!! However I had this very dilemma myself and I can tell you i was really worried about my decision concerning DJ and me seeming unreasonable as I was offered 8%. In my case it did not get that far. I did outright object any offers and was worried about my duty to mitigate losses after. I wanted my whole claim intact you see. I am no expert though of these matters as it did not end up in court. Lucid was a fantastic help {mindzais O/H}.

Hi thereshope, have just come to check your thread out as you have had a good reply to your questions by milktrayman in the 'Why is no one claiming the contractual rate of interest' - if you haven't seen it yet go check it out. I have a similar situation with Capital One at the moment, they have put funds on my credit card and sent me a cheque, I have not accepted their offer so have instructed them to remove the funds off my card and have sent the cheque back. If I had accepted my claim would be short of around £1,000, stick to your guns, I am and good luck.

Thanks for pointing me to MTM's reply. He has a way of making me feel that claiming CI is the way to go hun !

 

He is right, they have put in a full defence to my claim so full charges would have to be disclosed.

 

Sometimes you just need to hear someone else say you are doing the right thing !
