HI,

 

We successfully sued via Money Claim online an individual who did not supply us with our product or a refund for some garden gates despite having been paid a deposit via bac's.

 

The total claim with cost's etc was nine hundred and fifty pounds.

Defendant made no payment despite having CCJ in name until threatened enforcement action then contacted us to see if they could pay it in monthly instalments, which we allowed as not inhuman and realised it may have been covid issues affecting them.  

 

Paid no problem for four months totalling half of the outstanding debt then heard nothing more,

have asked what is going on as do not really want to send bailiffs to some ones door if they are struggling but still nothing

 

is it time for enforcement or do we think unlikely to see any more funds.

Your humanity does you credit, but the other side has to put some effort in too.  Simply stopping the payments with no explanation offered and ignoring your communications (after initially walking off with your deposit) is not on.

 

Who is this person?

 

Do you reckon they have the money to pay you?

As far as I can tell yes , they appear to own their own house and have a car, just feel awful if they have kids sending in bailiffs but can not figure out why they paid half and then stopped unless they think by doing so they can apply to have the judgement set aside.

Understood.  But how many chances are you going to give them

   - walked off with your deposit

   -  ignored PAPLOC

   - ignored court papers

   - ignored the court judgement

   - stopped paying with no explanation

   - ignored your communications

and probably loads more you haven't mentioned.

 

I'd be tempted to send them a letter saying they have broken the agreement to pay monthly with no explanation and have ignored your communications and therefore you want the full balance paid within 24 hours otherwise there will be immediate enforcement action.  The it'll be them who "decide" if they want the bailiffs round or not.

 

I'm no expert on these types of cases so hang on over the weekend to see what others think.

did you arrange this payments after completing a tomlin/consent order or just a private arrangement ....big fail if you allowed the latter.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
