Hi everyone,

 

I have finally got round to sending my S.A.R - (Subject Access Request) today 09/12/06 after having to wait till i'd moved house. Lets see what MBNA come back with and let the games begin. :)

 

I posted the above with the wrong Title so i have posted it again.

Back from a months holiday to find statements and a £310 goodwill gesture. Gonna tell them to keep it and pursue the £790 i have totalled up.:)

Good stuff! But don't tell them to keep it, it is yours! Tell them you are accepting it as partial settlement and will be pursuing them for the rest! Don't forget to add your contractual interest (the interest rate you are being charged for the pleasure of having one of their cards). In fact, if you ring them and tell them that, they seem to be going along the lines of settling the full amount and working out the contractual interest for you! Definitely worth a try and might save you a lot of time!

PS : Has anybody noticed the lovely flowery MBNA advert that is being shown on the TV at the moment? They are losing so many customers, they are having to try and find some more! Happy days!;)

Hi Guys,

 

Need some advice on this contractual interest thing. I've totalled up all my charges and they come to £799 over the last 6 years. I have entered it all into Vampiresses advanced spreadsheet and changed the 8% on the final page to 24.9% as suggested on some of the threads. It then says the interest is £657.43!!!

 

Is that right???

 

I'm confused now:confused:

quite possibly, the interest is compounded on a monthly basis rob so yes the interest could be as much as the charges.

OK phoned MBNA today to discuss it with them. I was told a specialist would call me back. Still no call back as of 16:20. I'll try once more tomorrow and if they don't co-operate will send the lba.

Hi there. I would strongly suggest NOT phoning MBNA - you will have no proof of the conversation, and if you come to any arrangement, they can renege on it and it would be your word against theirs. Whilst I appreciate there is a lot of backlash against all the banks etc., MBNA seem to be very high on the list of difficult ones. I'm sure you stand a better chance by following the tried & tested procedure on here. But merely my opinion!

Hi Guys,

 

Been really busy with other stuff and my MBNA claim has been delayed. I have finally gotten round to writing the prelim letter and will be sending it Monday morning with compound contractual interest added.

 

Just a thought. MBNA gave me 8 weeks to respond to their offer of the first measily amount of goodwill and I think I am well within this timescale. If for some reason I wasn't can I still continue the claim?

 

I haven't even sent a letter claiming charges yet so how they can say that their offer is in full and final settlement I don't know. Madness!!

I'd agree through experience with ladybird. Keep to the template letters, and ye olde fashioned written correspondence. Sent recorded of course!

 

Reference to the 8 weeks. Send your letter anyway, accepting the letter as partial only, and you will pursue the balance of you claim, through the courts if neccessary etc. The template library has a reject letter template too!

If need be, state that you have been unable to respond to the letter due to personal circumstances.

 

The thing is, they know whats coming, they calculate and allow for it, and damage limitation is a well practised art with them now.

 

Stick to your guns.

Ok prelim sent today for a total of £847 + £671.88 compounded contractual interest. Total of £1518.88

 

I'm well excited about the claim now and even more determined after seeing Barclays profits on TV this morning.

OK i have messed up and need advice. in the excitement of sending the letter to MBNA I forgot to say I accept their goodwill gesture of £310 as part payment towards the final amount. they have already paid this onto my card. Will this make a difference???

 

I'm worried i've messed up big time!!:(

You could write a quick couple of lines, confirming the 'partial payment' acceptance of the offer - but you will still be pursuing the balance as per your previous letter of xxxx.

 

if accepting the gesture of goodwill reduces the amount claimed in the most recent letter, send a complete new letter, new schedule, include the partial acceptance and ask them to disregard the previous letter.

If any timescales, you would be better of renewing the start date as per your new letter.

You've given them all reasonable time for due consideration of all facts then.

Thought i'd give you an update on my MBNA claim. I got a letter from them saying the usual and that they acknowledged my claim and they would reply to me sometime this year and if I had any questions I could phone the customer advocates office. I know the advice above said not to but I thought i'd give it a try as I consider myself to know what i'm talking about if they decided to give me a grilling.

 

Spoke to a guy there who said he wasn't an expert in the department but would arrange a callback. LEft him my number. Within the hour a girl phoned me and offered me a full refund of charges as a goodwill gesture. Admitting no liability of course. I asked about the compounded contractual interest and she asked if I wanted that aswell. Advised that yes I wanted it. She agreed to refund that aswell as a goodwill gesture of course.

 

So £1208.30 credited to my card. :) :) :) :) :D :D

 

Donation to the site on the way. Happy days. Just Barclays to do now.

It's definitely a big relief and gives me more confidence to go for the rest.

 

I currently have an LBA scheduled for Barclays tomorrow and a SAR for Barclaycard.

 

Then it will be Egg but I know they play extra nasty so am waiting till all the others are done incase they cancel the credit card when I take action. (That way i'll be able to pay off the debt)

Aaarrrggghhh.

 

Just tried to buy something on my card today and the (insert swear word here) have reduced my credit limit by what they refunded back to me. :mad: :mad:

 

I hate them!! I needed tyres for my car and now have to wait!!

 

I can't wait to pay the stupid card off then they can close the account and not get another penny from me ever!! :mad: :mad:
