    • Hi, I am a local authority tenant and was in a 3 bed house. At the end of last year, my last child moved out and so did my spouse as we are now going through a divorce which meant that I was in the house alone and decided that I needed to downsize not only for myself but to offer the property to a family that needed it. I registered on the local authority housing bidding site as i was asked to do and I was accepted and given a priority banding as I was downsizing and they were desperate for my house. I have been extremely lucky and after about 6 weeks was accepted for a new build from a housing association via the housing gateway. I viewed the property 2 weeks ago and had to sign the tenancy last week when they were doing bulk signups for the houses and that is the day I moved. In between viewing and sign up, I contacted my current local authority landlord and asked how I give notice as I had been accepted for a property I had bid on and was moving.  The lady told me how to do it online and then said that I needed to give a full weeks notice which wasnt a problem as I had enough time.  (I was also told a weeks notice was what i would need to give by another staff member about a month ago when I phoned up for another housing related question.  I dont have any of this in writing.) I have now moved, handed back the keys and I am now being told that I need to give 4 weeks notice which I cannot afford. I hav e spoken to the council again explaining that I was told a week and that to be honest, if I knew they were going to charge me 4 weeks I would not have been able to move and would have stayed in the other house.  I thought I was doing the right thing. They said that calls are recorded and they asked me when I called in and was told a week and they would listen to the telephone conversation and if it was correct what I was told, they would see what they could do to reduce the notice period. They have now emailed me back and said that they have listened to the conversation and the lady said 4 weeks notice and I am liable for 4 weeks rent.  Now I may well of misheard her when I thought she said a full weeks notice she may have said 4 weeks notice but I am sure she said a full weeks notice and i was told a week by another member of staff a few weeks ago. I have emailed her back and said that I may of misheard but I would like to listen to the phone recording myself.  As yet they havent responded. I think its unreasonable for them to make me give 4 weeks when I had to sign the new tenancy with little notice or loose the property.  And it was all done through their gateway, and they will have a tenant in there pretty much straight away getting rent from them. I am on a very low income, I am on my own, I have serious medical issues and I am really getting myself stressed out over this. Any advice would be so appreciated.  Can I insist they let me listed to the recording? RH  
    • Susan Crichton is at the Inquiry today. She seems to have trouble remembering a lot of things but seems to find it easier if it's something that shows her in a good light.
    • Send them a letter of claim straightaway. No point hanging around. Given 14 days in the letter of claim and if they haven't paid you by then, issue the claim on day 15. The amount of time is more than adequate for them to get going. Post your draft letter of claim here. A look at. Then log onto the MoneyClaim website and start preparing your claim and post your particulars of claim here for us to have a look at. Don't bluff. No point in it.
    • That's what we thought, but the store manager is inferring that, as the jeweller we used was not a member of the NJA, no one  would give what he said, any credence. The Jeweller we used is in fact, a long established, well respected company, with 2 store and rather than just being a retailer, they craft the most exquisite jewellery inhouse!  I wish my Fiancé would have bought from them rather than H Samuel! Do you think we do need to get another report from and NJA accredited Jeweller ?
    • Really pleased that you won. UKPC know that you have supremacy of contract but still they persist because so many motorists blindly pay them.   Muppets.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, we've recently decided to get quite a bit of work done in the back garden ( £12,000) including slabbing and walls built including privacy screens. They (well, there were 2 directors but now only 1 still active according to research on the internet) have left us with an unsafe garden, a mud pit and open walls so had to fence off top half of garden to prevent our dog escaping (12ft drop at the back). 

Gone to citizens advice and followed the recorded letters advice, We are hearing we aren't the only people he's done this to and are in contact with them. He's removed his Facebook page  although the business page still open. We got an incident number after contacting the police and have contacted actionfraud. 

Looking back we feel like such fools getting suckered in and its caused us untold stress, they seemed ok but once final payment was made they were hard work replying to texts,ignoring calls . cutting calls etc now the company phone is permanently off.

We do have an address but not sure if he owns property, no replies to correspondence either.

Any advice much appreciated as we don't have the money to put the garden right.

You need to start off by telling us who you are talking about here.

Secondly, you will need to get an independent assessment of the work which identifies any particular problems and the quality of the work generally and also advises on what needs to be done to remedy the situation. This might even include undoing all the work which was carried out and redoing it.

You need to have a quotation for that work so that you know the value of your dispute.

The company are called Griffs removals & renovations,  as far as I can see the walls are incomplete but look fine .Almost certain the bricklayers were sub contractors and they were doing as instructed.

 

 We;ve had communication with people who've had similar experiences as ourselves and whether or not to trust strangers comments he's broke and hires flash cars and also claims housing benefit.

 

Digging deeper he's had a couple of companies that are dissolved according to gov.uk

Did you contract with them as a limited liability company or simply as a sole trader or trading partnership?

There is certainly a limited liability company and that name – about 18 months old, so that doesn't bode too well because it's easy enough to Phoenix something like this.

You say that you may have an address – you can check the address on the land registry web search. It will cost you a fee of about £3 – well worthwhile.

See what you can find out.

 

You deftly needed inspection as I've already suggested. If you want to make a claim against them then if the inspection supports what you say and if the builders are uncooperative then you can bring a claim and you will most certainly win.

However enforcing a judgement against a reluctant trader is a difficult matter and certainly if you have been dealing with a limited liability company which decides to dissolve itself then you are on a hiding to nothing.
If you have been dealing with simply a non-limited liability trading organisation then if you can identify assets you have a reasonable chance of enforcing a judgement.

As far as I know its just a LTD company nothing to say Liability that's advertised on yell and gov.uk and shows still active. I just looked he has another correspondence address on opengov.uk  in Abergavenny. His brother ( director that's recently left the company) gave an address on gov.uk I that comes up as a taxrefundsus in uxbridge when googled.

 

With someone to come and evaluate the garden would you recommend a QS or another builder?

 

I will definitely sort out the land registry first thing tomorrow, I'm starting to think he hasn't got any assets and its all show but hoping something can be done about his future earnings and any repayments to us. I know it's a cruel world and we as many should've been more sensible but it pains us someone can get away with doing it.

 

Also, I cocked up the headline it should of said 4-5 payments  only 2 were bank registered.

 

Is it worth instigating court proceedings before the deadline stated in the second letter?

Thank you, but you haven't answered the question as to who you actually contracted with. It's very important to know whether you have contracted with a limited liability company or simply with some trading operation.

Do you have receipts? Who did you make out a cheque to? Was there any kind of written contract?

Hi BF

 

We advertised on FB and the directors came to view the job and we agreed a price with them. We saw them titled just LTD on their FB page. No written contracts just text and emails between ourselves.

  We agreed the payments to be made in instalments ( cash and bank transfers as not always possible to get to the bank whilst in work) .No reciepts but bank statements. We have contacted the bank but they say they cant help because work was started :( 

 As I say they say LTD on their company name no mention of LLC.

In terms of who should carry out the inspection, it should be somebody who is competent and experienced and completely independent of this company that you are in dispute with.
You should make them aware that there is a dispute and you would like the assessment in writing. You need to get it done quickly but you should probably look around and see who will do the best job for a reasonable fee.

I've looked at their Facebook page and I don't see any sign that they are saying that it is a limited liability company – and in fact it will be better for you if they are not and you are suing the person you are dealing with in person.

What is the name of the person you actually dealing with?

In terms of payments, when you given the name of the bank account? Did it appear to be a business account? Did it appear to be a personal account?

We've arranged for someone to come and look for us on Wednesday so we'll get a quote then and ask for it in writing, but will also look for other quotes aswell.

The actual person we've been dealing with is Alun Griffiths he owned 85%  shares and im guessing 100% now his brother has recently left.

With payments via bank (some were cash we've got emails/texts to prove it) my partner made them I'd guess it's gone into his personal account. He's also advertising finance of up to £100.000 made payable over 10 years on his page so we thought he was the real deal (even though we didn't need it). 

Theres also a video of them working in our garden he put on there. 🤢

What was the name of the business account? Was it a limited liability account?

I think you are going to be in a very difficult position if you can't identify company assets.

I think that you need to start taking action to understand the extent of your problem and the value of it. You don't know either of these things yet.

You will need to get some kind of assessment carried out but be careful about spending money on a fee because if it turns out to be expensive then you will probably have to bring a claim against the company and although you will win – you may well have a lot of difficulty enforcing the judgement and you will be out of pocket even to the extent of your claim fee.

I don't think you can do anything more before getting an assessment and a quote so that you understand exactly what your position is.

Once you do this, then we can help you approach the company and also I think it would be well worth dealing with them and saying that you want a proper receipt and VAT receipt et cetera – which you may will find are difficult to get hold of.

Get the assessment first. I'm afraid it's an absolutely necessary first step.
