I used Packlink with the intention of sending some  jewellery, sold on eBay, by Royal Mail Special Delivery but the printed label and tracking details could not be scanned at the Post Office. Packlink state my issue is with Royal Mail to refund the cost of the label, and not themselves. Surely under the Consumer Rights Act they are liable as I bought the service from Packlink? I pointed this out to them but they keep replying that they do not deal with RM!!

Under the Contracts (Rights of Third Parties) Act 1999 you will generally have a right to sue Royal mail – assuming that there is actually a contract between Packlink and Royal mail.

Has the contract actually come into being?

I have to say that I don't fully understand the story and also I don't understand how the system works at that level. If the parcel had actually been sent then we would know that Royal mail had undertaken a responsibility – but as it appears that there was simply difficulty scanning the label, it's not clear whether it has gotten to that stage.

How much money are we talking about here?
