Hi All!!

I have just jumped on the bandwaggon and sent off my statements along with a letter to NatWest after years of being charged up to £60 per charge a month. I worked out they'd charged me £1890. The cheeky [email protected]@!!s!!!! They made me snowball and i've struggled ever since. I will keep you updated with my progress and may need some help along the way as it seems Natwest are hard work! Did anyone have problems with getting statements from Natwest from before Oct 2003? They told me that because thats when they merged with RBS they couldn't get statements from before then. Which is a load of rubbish because i used to work for them in the statements department and it just means changing back from the RBS screen to the old Natwest screen to order them. SO IF THEY TELL YOU YOU CAN'T... BE STRONG... THERE LIEING!!!

I just called Debenhams to and asked for my statements from my store card with them and they tried to fob me off saying that i can only have statements from may 2005 to aug 2005 as there system hasn't been working since!! Which i'm guessing is a load of s!*t!! I have said i will order the statements they offered me and write to them for the rest as they have to give me them as it is against data protection not to. Is this right? will i get them now do you think? I'v also just sent a letter to topshop to get my statements so i'll keep you posted about that too.

I also have a credit card with NatWest, do i claim this seperately from my bank account?

Thanks All!!!!

Just ordered my statements from Egg Credit Card. They werer really helpful.. as my account was closed they sent me them as a complaint for free... wooohooo!!!

Rang Debenhams back and spoke to somebody else who ordered me all my statements straight away. yippeee. They're charging me 50p per statement. I'v also ordered statements from Topshop and am in the process of ordering them from Capital one, Halifax Credit Card and Natwest Credit Card. Does anybody know if i claim the Natwest credit Card charges seperately from my bank account?

Hi loristar you start separate claims and separate threads for all of them, you sure you wanna take them all on at the same time? Tis up to you though.

As for being charged 50p statement etc the max you pay is £10 as per the SAR, is this the first step you have taken or are you just ringing up for statements?

As everyone is getting their statements I find it strange NatWest said they couldn't, with such a lame excuse that makes them look incompetant!

Not sure from what you've said, if you have spoken to them on the phone, but it is better not to and keep everything in writing. That way you have something to check with and not depend on your (and their) memory.

You are taking on a lot in one go and it may become confusing. It may be better to do a trial one.

Chedder and myself have done detailed threads and we have both won against NatWest.

Thanks Cheds

I just want to get the ball rolling, and i'v heard from people to start them as soon as you can. i took my first letter, statements with all the charges highlighted and a copy of the charges with interest added to my bank yesterday. With the second letter, which i'm sure i'll need to send!!!, do i have to send another set of the statements? as there was too many for me to photocopy, and it means me having to order and pay for more. I read your story... well done! I struggled to understand some of the technical stuff though so am a little concerned about the later stages. Is it easy to pick up along the way?

Lori, you don't have to take/send the statements, write out the list of charges on a seperate sheet.

The address I used for all of it was

135 Bishopsgate

London

I didn't, just put the address.

NatWest took their time at first but weren't too difficult with me.

Once you have the hang of what to do it gets easier, but Natwest were my first.

Stop panicking! You will be fine.

Always stick to your time scale, don't let them fob you off.

Here is some advice:-

1) Do not order statements without the S.A.R - (Subject Access Request) letter.

Some banks can charge £10.00 per statement.

2) Retain all the statements, do not give them back to the bank as evidence.

3) Carefully analyse the statements

4) Prepare your spreadsheets

5) Prepare your action plan and stick to it.

Good luck

My advice has hardly any legal foundation whatsoever, however you never know it it might just work!

Hi, Ataction

You said

"Some banks can charge £10.00 per statement."

If you mean per sheet of paper, or monthly statement, that is not the case. the DPA lays down a maximum fee for providing information under an SAR, and it's £10 in total.

Otherwise, all fine.

:-? Westy,

Yes banks and other financial organisations can charge £10.00 per statement sheet, that is why I stressed the S.A.R - (Subject Access Request) letter is so important.

Loristar as long as you have recorded the charges then you should be OK, it does not make sense to order bank statements and then give them back to the bank. They have all that information.

Please have a look at Vampiress spreadsheets, this will give you an insight into how to schedule your claim and calculate the interest due.

My advice has hardly any legal foundation whatsoever, however you never know it it might just work!

If you have listed all the charges and dates and still have that list, I don't think you will need to ask for the statements again.

There are letters you can use in the forum library, although my first letter was really short and to the point, saying

"under the the data protection act and SAR please send me the statements for account ******. I am enclosing £10 for this. I believe you have 40 days to do this"

I got the statements, although there was a bit of a hold up as I requested them for two accounts and they sent one accounts twice. Had to point out their error twice, then I got the rest.

After that I used the forums letter's, then a letter Hagenuk helped me write.

What you need to do now is enter all thes details into one of the spreadsheets, this will then act as your schedule.
