Please give us a brief Bullet-Point summary of events including approx dates. Start with how and when you heard of FTR, the contact you had with them, what authority you gave them to act for you with HMRC, how HMRC then contacted you about needing a refund, what years you owe for and how much for each.

 

Include info about contact with Action Fraud, Police, etc.

The info you post about Maxwells Accountancy Services is v interesting and will be discussed by the Site Team.

 

In the meantime, please tell us :-

 

1. Briefly what was said when you spoke to HMRC after they asked for (I assume) EIS Certificates.

 

2. When did they issue the tax demands and when did you "appeal" them.

 

3. Have you had a Crime Ref No. from the police or Action Fraud.

 

If you know of others who were drawn into this Con, please get them to sign up here and post their experiences - the more who challenge this Scam in an organised manner, the better.

There may come a time for Schipoo (or CAG) to try and involve MP's and/or the Press to see if pressure can be brought to bear on HMRC .

 

But we're still trying to gather all the info we can from any CAGgers who have been scammed by FTR and any other companies involved.

 

Hopefully, if more "victims" come here, this may improve the chances of HMRC taking note of the complaints about the Scamming Companies.

I see you posted earlier on Dixon's thread - please only post on your own thread to keep everyone's threads shorter and focused.

You mentioned a SAR again FTR, should o do that aswell? 
 

Also mentioned was a judgement, does that mean you’re trying to get the money back from FTR?

Personally, I see no point in sending an SAR to FTR as they will not reply. Nor do I think Dixon will get anywhere despite the CCJ awarded to them against FTR.

 

If the SAR has gone off to HMRC, wait for their reply.

 

And do your best to get other victims to sign up here and post their own story.

We will discuss the Action Fraud response which is totally unacceptable and come back with a suggested reply.

 

Please confirm, approx how many other FTR victims are you aware of.

Please bear in mind that I have no idea what was lodged by FTR on my behalf resulting in tax being repaid to them. I am entitled to this information.

Hi Schipoo and thanks for the update.

 

Crazy that HMRC expect you to make decisions when you still await important info but you've done the right thing seeking the independant review.

 

I'd like the response to Action Fraud to reflect their totally inadequate stance but please hold fire in the meantime while we continue to look at all options.

 

In the meantime, I think you should go back to the police and ask what action they intend to take against people behind FTR who have fraudulently reclaimed tax rebates on your behalf.

Can you please carefully double check each copy return, look for Reliefs or Allowances and confirm :-

 

1. Is there any mention of an EIS claim or a company you "invested in".

 

2. Check under s.21 - Additional Information.

 

3. Is there anything mentioned about an Agent completing the return.

Hi Schipoo,

 

Your best chance of getting HMRC to rethink their position or attitude is to get others who have been affected to sign up here so we have more cases to show as being similar in nature.

 

If you know any others, get them on board quickly. We're invloving other bodies who may have influence in such matters.

Dixon had a reply from the same office saying their appeal was being challenged so your case being postponed for 3 to 4 months is fine for now.

I see no need to.

 

They say, " Unless I hear to the contrary, I will assume that you have no objection to the review period being extended so that it expires on 10 January 2022.

 

By 10th Jan 2022, we will have a good idea of how this is all going.

 

Just watch out for that deadline and shout here if we get to within 14 days of it.

This review process is not the right arena to disclose info to HMRC about FTR, their scheme or their Director.

 

I understand your frustration but now is not the time to try and pass on that information.

 

If you want to make progress, can you get back to the police and ask what is being done to investigate FTR and their fraudulent activity. Report back here please ..............

Initially, HMRC will be interested only in checking the EIS relief given and recouping any tax wrongly refunded. As far as HMRC were concerned, the tax refunds were claimed by, and repaid to, the individuals.

 

Once they are aware of the scale of the fraud by FTR, I hope HMRC will be unable to ignore the fact that this is fraud attack on HMRC using the tax accounts of the individuals.

 

I believe it is down to the individuals to press the Police to recognise this matter as a serious fraud that just happens to involve tax. I don't see it as a "tax fraud" as described by Police in Schipoo's post above.

Hi Schipoo,

 

I suggest you go back to your local Police and tell them :-

 

1. This is fraud and must be properly investigated.

 

2. If they insist again that you go to Action Fraud (who have already said they'll do nothing that helps you), tell the Police you want contact details for their Cheif Constable so you can file a written complaint.

 

We've seen Police reluctance here before about taking cases seriously and investigating properly. You have to stand up for yourself and insist that they act.

I doubt this is the case as the EIS relief was claimed by FTR using each taxpayer's Gov Gateway tax account but HMRC had no idea at the time that the claim was filed by FTR and not the individual taxpayer.

 

Acting in this manner, FTR had no need to be registered with or recognised by HMRC or a professional body - they were not acting as a tax agent.
