    • Good afternoon, I am writing because I am very frustrated. I received a parking fine from MET Parking Services Ltd , ( Southgate park Stansted CM24 1PY) . We stopped for a quick meal in Mcdonalds and were there fir around 30 mins. We always do this after flights and never received a parking fine before.  Reason: The vehicle left in Southgate car park without payment made for parking and the occupants southgate premises. they took some pictures of us leaving the car. i did not try and appeal it yet as I came across many forums that this is a scam and I should leave it. But I keep getting threatening letters.  Incident happened : 23/10/2023 I did contact Mcdonalds and they said this:  Joylyn (McDonald’s Customer Services) 5 Apr 2024, 12:05 BST Dear Laura, Thank you for contacting McDonald’s Customer Services. I’m sorry to hear that you have received a Parking Charge Notice following your visit to our Stansted restaurant.   We've introduced parking restrictions at some of our restaurants to make sure there are always parking spaces available for customers.   We appreciate that some visits such as birthday parties or large group visits might take longer and the parking restrictions aren't intended to stop this. If you think your stay will exceed the stated maximum parking time then please speak to a manager in advance.   Your number plate is scanned by our Automatic Number Plate Recognition (ANPR) system when you enter our car park, and then again when you leave. If you have overstayed the maximum time allowed, you will not be notified straight away- a Parking Charge Notice will be sent to you via the post.   If you feel that a Parking Charge Notice has been issued in error, please contact our approved contractors who issued the charge in order to appeal the charge. Unfortunately McDonald's are unable to revoke parking tickets- the outcome of the appeal is final and cannot be overturned by McDonald’s.   Many thanks for taking the time to contact McDonald’s Customer Services.   Can someone please help me out and suggest what I should do next?  Thank you 
    • Good Evening, I've got a fairly simple question but I'll provide some context incase needed. I've pursued a company that has operations in england despite them having no official office anywhere. I've managed to find a site they operate from and the papers there have been defended so I know they operate there. They've filed a defence which is honestly the worst defence ever, and despite being required to provide their witness evidence, they have not and have completely ignored the courts and my request for copies of it. I'm therefore considering applying to strike out their defence on the grounds the defence was rubbish and that they haven't provided any evidence for the trial. However, it has a trial date set for end of june, and a civil application wouldn't get heard until a week before then, so hardly worth it. However, my local court is very good at dealing with paper applications (i.e ones that don't need hearings, and frankly I think they are literally like 1-2 days from when you submit it to when a Judge sees it. I'm wondering if I can apply to strikeout a defence without a hearing OR whether a hearing is required for a strikeout application.   Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

There may come a time for Schipoo (or CAG) to try and involve MP's and/or the Press to see if pressure can be brought to bear on HMRC .

 

But we're still trying to gather all the info we can from any CAGgers who have been scammed by FTR and any other companies involved.

 

Hopefully, if more "victims" come here, this may improve the chances of HMRC taking note of the complaints about the Scamming Companies.

Personally, I see no point in sending an SAR to FTR as they will not reply. Nor do I think Dixon will get anywhere despite the CCJ awarded to them against FTR.

 

If the SAR has gone off to HMRC, wait for their reply.

 

And do your best to get other victims to sign up here and post their own story.

Update

 

i have received my SAR but it only has the correspondence attached that hmrc have already sent me, notes from the telephone conversation I had with my case worker and a note between her and a colleague saying that they wouldn’t impose a penalty. Please see below…

 

“I refer to your recent SAR request and attach our response together with all relevant documents. Please note that certain details have been removed from some of the documents for security purposes.

In the above case opening letters were issued 23 February 2021 for 2017/18-2019/20. A reply was received from the customer (tel call followed by email documents) and we are now ready to restart.

 

This case is similar to one that you have recently looked at for me in that the customer was naïve/trusted her agent and it is doubtful whether careless behaviour would be supported if the case went to Tribunal. I believe we should classify this as MDTRC and not charge a penalty.

 

Please can you confirm your agreement to both FRB and no penalty

Subject: EIS CASE -

I agree that this case should be treated as MDTRC for the reason stated. There is no evidence of deliberate behaviour, and I doubt if she will be so trusting again. Therefore it seems highly unlikely that she is going to repeat her mistake.

Internal Notes 12/07/2021

 

Technical advice sought re the particular circumstances of this case. An SA record was set up for expenses over £2,500. The return came in without these expenses so the SA record is automatically closed.

Per technical advice, behaviour agreed as MDTRC. The customer placed trust in her agent

 

Please note that non-personal information relating to HMRC’s internal processes and guidance have been redacted or removed. Names of HMRC officers not directly involved in the compliance check have also been removed.

 

MDTRC - mistake despite taking reasonable care

 

I’ve also had a letter with the results of the review which I believe is the same response Dixon and Alvinsmalvin have had where they state although they empathise the responsibility lies with me to repay as I gave Fast Tax Rebates Ltd my information.

Still really struggling to upload the Hmrc 5 page letter, I’ve downloaded all kinds of apps on my iPhone with no joy. 
 

In the meantime I will be responding  to the SAR as below, please check it’s ok

 

Further to your response regarding my SAR and also the letter dated 27th July, the SAR doesn’t include any information regarding Fast Tax Rebates Ltd, and also how the decision to investigate my tax affairs was reached. You must inform me if the decision was totally random, or if it was information made available to HMRC from whatever source. 
To be clear, I require any tax returns, submissions made, and documents submitted on my behalf from Fas Tax Rebates ltd, communications between Hmrc and Fast Tax Rebates ltd, tax calculations, file notes, memos sent or received, information about the decision to review my tax return and/or income tax affairs. 
 
Please now respond properly to my SAR addressing all relevant points by return of post as you’ve already had the time allowed to respond. 
 
I cannot respond to your last letter regarding the 3 options until I have this information for me to make the decision to move forward, consider all the data and take advice. 
Please therefore postpone any action until hmrc respond to my SAR has been completed properly.

Hi,

 

last year a company called FTR Ltd contacted me and advised i was possibly due a tax rebate. I agreed to let them check, they came back to me a couple of weeks later and said I was due a rebate for the sum of £2626 which they would pay into my bank.

 

I received a letter from Hmrc a couple of weeks ago requesting a sum of £7800 or send proof of the enterprise scheme I had invested in. I’d never heard of an enterprise scheme or had this amount of money. A self assessment has been done in my name which I was never told about and would never of agreed to.  

 

I was also never told about any investment scheme. I have reported this to action fraud, emailed HMRC with a crime reference number and asked them for a SAR and to put this on hold until it’s looked into as this company had scammed me. I’ve not heard anything back yet apart from that they are looking into it. The deadline was 7th aug,

 

I’m getting a little worried as I’ve not heard anything back. I’m not sure what to do next or how to try resolve this as the company that have made the fraudulent claim in my name are now where to be found. Any help with this would be much appreciated.

You've done the right thing by telling Action Fraud and sending the SAR. I don't know about the deadline, but site team member @slick132is great on HMRC matters - I expect they'll be around later.

 

If FTR Ltd followed the same MO as with our other members, they asked you for access to your online Government Gateway account and then the code that HMRC sent you in the post? Please have a read of the other threads here. Nobody has reached a conclusion so far, but you'll understand a bit more about what's happened.

Brad, are you able to access your self-assessment form on the HMRC website please? It doesn't help your cause at the moment, but dixon2094's tax record shows that the company FTR said he invested in was linked to Alan O'Hara who set up FTR Ltd.

 

I know that the EIS question is on page Ai 2 of a tax return but I'm not sure where the company name is shown. Maybe @dixon2094 could tell us where they found the information on their online return.

 

As you may have read, there's no public list of companies that are allowed to run an EIS so you can't check, but it's very disappointing that HMRC may not be checking.

 

But if you could tell us which company FTR put on your tax returns, it could come in useful later on.

 

Did you change your password after you got the rebate? If you didn't, once you've tried to find the information for us, I think it's worth doing that.

Hi @honeybee13 I don’t know, I’ve never tried to, I’ve never received any details for the self assessment, I didn’t even know one had been opened until last month. I’ll check the paperwork I received from HMRC last month. If it’s not do I request this from HMRC? I’ve never done a self assessment so not sure what to do or where to go for it?

What FTR normally did was to ask for P60s and access to your online account, then they submitted what suited them. Does this sound familiar?

 

Have you ever used your online tax account? And do you have any paperwork for what happened?

Well, I think it's worth trying to access your government gateway account for your own peace of mind in the future. You don't want anyone connected with FTR accessing your tax records again, which I think they could because you gave them the code.

 

Did you give them your P60s?

Ok I’ll do that thank you. Yes I gave it them, ive emailed HMRC as well to take any 3rd party off my account. I don’t even know how to access my tax records? Do you think it’s worth ringing HMRC? I’ve never done or been through anything like this. It’s really worrying me.
