      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Pondy Update!

 

Bad news day! :(

 

2 letter's from [problem] out of the blue asking me to repay my overdraft and loan in 7 days or i'll be taken to court! :eek:

 

I had agreed token repayments on both of these accounts with Lloyds in conjuction with my repayment plan worked out with the CCCS (Consumer Credit Councilling Service). Lloyds agreed this (In writing) and told me the accounts would not be transferred to their collections dept.

 

So why have i suddenly recieved this ultimatum from thier solicitors when they have not even as much as phoned? 2 months ago they were ringing every other night.

I could jump to conclusions here, and assume it is retaliation to my claim.

 

Any thoughts on how best to handle this?

Any thoughts on how best to handle this? Hi Pondy, I would consider making a complaint to the OFT and stating they are doing this as a retalitory action because you are taking them to court.

What stage are you at?

 

If you have filed then surely [problem] couldn't defend against you and also claim against you, I may be wrong.

I've been very busy over the last couple of days, so have'nt had a chance to get to the bottom of this. Think i'll ring Lloyds first and see if they are even aware of this! Last conversation i had, i was assured my account would not be passed over to debt collecters whilst i made the token repayments agreed. So it is a bit surprising to get a letter threatening legal action from [problem] without even so much as a phone call from Lloyds.

 

Yes, i filed some time ago, and have a court date for 7th June.

Time for a Pondy update....

 

But not this time......

 

The fish was "floundering", but CAG has tipped the "scales"!! This fight looks to be "fin" ished.....

 

:D I've WON!!!!!! :D

 

Letter from [problem] arrived today saying they would pay (Unconditionally) £4804.78 into my account in the next five days.

Checked my account, and Yahoo it's there!

Gonna stay on the ceiling for a while, drink a few beers, then check the figure is correct. ;)

It couldn't come at a better time, and hopefully life is going to be a little better from here on in.

Big thanks to everyone who helped me over the last six months, especially Tanz, Bill-K, Photoman and 121o121.

Message to everyone still going.... stick with it, you'll get your money back, and it's a mighty good feeling. :D

So could a Mod move this thread over to LTSB successes? And i will make my donation once i get myself sorted.

Is this the end of the Fish? Hmmmm, I don't think so, kinda addicted now, and there is a small matter of two credit cards, plus some charges added since i started this claim, and i've been looking at the new thoughts on charges over six years old!!!! That should keep me going!

 

Gotta go, some celebrations to sort out!

Well the celebrations were a little muted as i could not withdraw any money! Lloyds must have de-activated my cashpoint card, as it was swallowed by the hole in the wall. :(

They really know how to annoy a customer don't they?

Anyway i have checked the payment covers all the court costs - AQ - and interest up to the day they paid, and surprisingly it is spot on. :)

Yes it is a great feeling Tanz, and no need to worry Empowered, the fish was determined to win, but i appeciated your words of encouragement after that hiccup (which proved to be a storm in a tea cup!).

Donation as soon as i can get my fins on the refund.

Refund has now cleared in my parachute account, and i have just made my donation. :)
