Hi everyone 
We bought a car 14 days ago From Chobham Central Garage using Blue Motor Finance( hire agreement).

 

Straight away we noticed a problem- judder when the car accelerating between 1st and 2nd gear .

We called an automatic gearboxes specialist and he said it’s possibly coming from the gearbox but he doesn’t do this kind of gearboxes .

 

We informed Nathan ( who sold the car) and we was offered to fix the problem .

We left the car with him and 2 days later he said that the transmission mount was changed and the car is tested and ready to go . 
Unfortunately we realised that the problem is still there.

 

he offered us to attend the nearest garage and to find out exactly where problem is and they will cover the cost of repair. we did this and the specialist said he believes the problem comes from faulty clutch in the gearbox but they also don’t do these gearboxes.


At this point we decided to reject the car because of the serious problem about which we weren't aware before the purchase. 
Nathan said , no problem we can do this and he transferred us to “his customer service “ Alex, who contacted us through  [email protected] 

 

We informed the finance company for our decision and later on they said there will be investigation because the other side ( trader ) wants to repair the car instead .

 

We contacted Citizen Advice and opened a case .

Also we was advised to send a letter which said that we want to reject the car under Consumer Rights Act 2015 .

 

 Of course Alex said that they are not agree. We contacted The Motor Ombudsman- they can’t help us as the company is not registered with them .

 

Citizen Advice told us the we can send now Letter Before Action ( before take them to the court) .  

They also said we have to deal with finance company, not the trader because we have hire agreement with them .

 

And here we are … I don’t know what we need to do next .

Ahmed Alwaheeb's firms sold cars riddled with faults - and which sometimes had government recall notices that required manufacturers to fix safety issues - but refused to refund customers.

 

 

You have bought your car from a bunch of dealers who don't seem to be very scrupulous about the way that they operate.  However, you have saved yourself by using a finance company.  I think that you may be the first people we have come across who have not paid cash to this company.

 

Citizens Advice are right that if your arrangement is a hire purchase arrangement then your action will be against Blue Motor Finance - 

 

 

Chobham used to be registered with the Motoring Ombudsman but they withdrew after some decisions against them.

 

The so called Motorcomplaints service which is apparently run by someone called Alex, is in fact part of the Chobham/EMC etc bunch and seems to have been setup to make customers think that their complaint has been reviewed by an independent arbiter - when in fact it hasn't.

 

The motor complaints service to which you been referred by Chobham and which is apparently run by Alex should not be confused with the Motor Ombudsman scheme which is a legitimate organisation although frankly it's probably not very useful anyway.

 

All of this has been reported to Citizen's Advice and Trading Standards many times and nothing has ever been done about them.  Even the Daily Mail article failed to prompt any authorities to take any action

 

Blue Motor Finance are wrong to tell you that they have to investigate first.  The dealer has no right to insist upon a repair as you have reacted and asserted your rights within 30 days of purchase.

 

You will have to get tough with Blue Motor and we will help you.

You say that you had some communication with Blue Motor Finance. Did you do this on the telephone or in writing? You should read our customer services guide. It's extremely important.

You should try to do everything in writing but if you have to do things on the telephone then you should make sure that you make detailed notes of your call and then confirm them in writing. So for instance if your discussion with Blue Motor Finance was on the phone, you should make a note of everything that was said – including the fact that they said that the matter would have to be investigated because the dealer was prepared to carry out repair – and you should send this to Blue Motor Finance with a note confirming that this was the conversation they had with you.
It is very important to develop a paper trail. Otherwise everything becomes deniable.

The situation is that if a defect occurs within the first 30 days of ownership of the vehicle then you are entitled to reject the vehicle under the Consumer Rights Act. You have to assert this right by contacting the dealer – and in this case Blue Motor Finance – in writing and point out that you are asserting a right under the Consumer Rights Act 2015 and you are rejecting the vehicle. Tell them that you want arrangements to be made to give you a refund of all costs including any costs or interest which has been levied by the finance company.
Be tough with the finance company. Don't act as if they are do you a favour. Make sure they understand that you are not in the mood to muck around and you won't wait very long either.

Don't forget that in this case because you have purchased the vehicle through hire purchase, it is Blue Motor Finance which is the responsible party. That is going to be helpful because if you had had to deal only with Chobham, you would have had very serious difficulties.

In addition to writing to Blue Motor Finance to assert your rights, I suggest that you send them a copy of the article from the daily mail which has been linked above and you can draw their attention in your letter to the fact that this is the company that they are dealing with.
You can send these messages to Blue Motor Finance by email. You should do this urgently. This weekend.

You should also tell Blue Motor Finance that you have now taken advice and that you now understand that their initial statement that the matter needed investigation and that the dealer was going to carry out repair, is unacceptable and actually unlawful and contrary to the short-term right to reject contained in the Consumer Rights Act. Tell Blue Motor Finance that if they will not cooperate immediately in returning all of your money and cancelling the finance agreement that you will consider legal action against them for breach of contract and also for treating you unfairly country to their statutory duty under regulations developed by the Financial Conduct Authority.

You should stop driving the car immediately. How far away from you is the dealer?

Frankly you want to get rid of the car as quickly as possible. If you had not had finance in place then we would have cautioned you about this because you could end up losing possession of the car and also not having your refund.
However, as you are dealing with a regulated finance company, and of course as the money has been loaned to you and you have not paid a great deal of it back it, your best interests would be in getting rid of the car so that it is no longer your responsibility to maintain, to insure or to generally worry about.

 

In addition to the hire purchase loan, did you pay anything on deposit? How did you pay? Did you pay by cash or by debit card or credit card?

If you're confident then you should drive the car carefully to the dealer and leave it with them on their forecourt. Do not leave in the streets. You should photograph the car inside and out so that there is no argument later on as to the condition of the car when you returned it.

If you are worried about driving the car then you should tell Blue Motor Finance that you want them to make immediate arrangements for the removal of the vehicle. Tell them that you are giving them seven days to organise this at the end of which you will charge in storage at £10 per day. This is assuming that you are keeping the vehicle on your own property and not on the road.

As soon as you have got rid of the car, you should take immediate steps to inform the authorities that you are not the owner of the vehicle. Make sure that when you return the car it is returned with all its paperwork but you should use whatever portion of the V5 is necessary to transfer ownership away from you. Take copies of all the documentation before you hand them back.

If you fail to do this and if the dealer does not change the ownership – then you are at risk of some other person driving it in your name and incurring penalties for road traffic offences or parking offences. That will then give you more complicated problems to deal with as you have to try and convince people that you are not the owner and not the driver of the car at the time.

You should calculate exactly what this whole thing has cost you. This means all of your out-of-pocket expenses including the cost of going to see the car, going to fetch it, driving it back, any expense of insuring it or anything else because later on we will help you claim all of this back. Of course you will claim all expenses and fees et cetera associated with the finance agreement.

As a matter of interest, how recent is the MOT on this vehicle? Who MOT'd it?

Thanks so much for your quick response. 
All of my communication with Blue Motor Finance , Chobham Central Garage and [email protected] is over the email. We called Blue Motor Finance several times but they were not very helpful . Hire agreement is on my husband’s name but I will be the registered keeper if this matters.

I have no idea what are their full names because they use only their first name - Nathan and Alex .

Vehicle details- Ford Focus Automatic reg.: XXXXXXX  96600 £4300

 

We paid £200 deposit via visa debit. The rest £4100 we have to pay to Blue motor finance in the next 48 months + interest . The total amount £5489.16.

 

I have already sent an email to Blue Motor Finance ( this morning)with all the points you mentioned previously.

I hope this will help.

Should I just wait for their response now or to call them so they can confirm they received my email?

If the hire purchase agreement is in your husband's name then it will be your husband who will have to bring any complaints, bring any legal proceedings – et cetera.

Write to Blue Motor Finance in the way that I have suggested. Point out that you have asserted your rights under the consumer rights act to reject the vehicle and that is the end of the matter. Tell them to start making arrangements to refund your the money and tell them that you won't stand for any nonsense. If you have pointed out to them already tell them that there will be legal proceedings unless they sorted out extremely quickly.

What have you done to get rid of the car?

If you've got Blue Motor Finance's prevarication in an email that that is excellent and you will use that against them. This thread has already been tweeted out to them and they will see the tweet on Monday and they will understand that they are been discussed on social media – and that it doesn't look very good.

I'm sorry to say that you have to keep the pressure on very hard. You expect this of these kind of car dealers. You don't expect it of a regulated finance company – but am afraid that some of the poorer ones do act like this all too often.

You can certainly call them if you want. What you definitely want to see what a reference number and if you call them tell them that it is a complaint. You can also tell them that they are been discussed on social media.

Please keep us updated. I'm afraid that this is unlikely to be the end of it.

After my email (stating all of the points you mentioned earlier) to BMF we decided to call them . We spoke with the person who deals with our complaint. I just said everything that I already sent as an email. 


I asked him why they are doing investigation if my right is to reject the vehicle . He said that they need to give the seller time to sort this out. He also said that the seller is responsible about this situation as much as they are . I’m going to call the Finance Ombudsman on Monday to see if they can help.  


I told BMF that  they have to make immediate arrangements for the removal of the vehicle . I don’t want to be responsible for it as I already said that I’m rejecting it and they have to deal with this. He said that it’s my responsibility until everything sorted out. They received my evidence- report stating the problem . They need now to contact the dealer and advise him to take the car back because we are in our right.


I gave them time until Tuesday .

 

However I will keep sending them emails and call them on Monday to see what is going on.

Once again, put it all in writing and send it to Blue Motor Finance so that the conversation is confirmed. Once again, tell them that they are avoiding their obligations under the consumer rights act. Tell them that the only "sorting out" that you want doing this that they start cooperating and helping to organise the rejection of the vehicle.

I'm afraid that what you are coming up against is fairly predictable. Finance companies don't like this kind of thing and the less reputable finance companies to to cause many more problems.

I think also it might be an idea to make it clear to Blue Motor Finance that in fact you won't be using the ombudsman to enforce this. You will be going directly to the County Court.

If you are happy with that route then you should let them know about it in your email and tell them that if you don't have a definite arrangement in place by Tuesday that you will be sending them a letter of claim on Wednesday and then starting a claim in the County Court not only for breach of contract but also for treating you unfairly country to the FCA conduct of business regulations. COBS

I sent the link to Daily mail article. I also discussed that with them over the phone. He said that he is not able to comment it as it’s not part of our case . I said - but that shows what kind of fraud companies you deal with . 
 

I’m going to email them again today with confirmation of our conversation from yesterday. I will also explain them everything again exactly as you advised me .

This is in response to my email to them yesterday stating that we will take legal actions if they don’t cooperate immediately we will consider legal action against them for breach of our rights and also for treating us unfairly contrary to your statutory duty under regulations developed by the Financial Conduct Authority and Consumer Rights Act 2015.

Well you save it down by printing it to PDF rather than to your printer. Then you attach the PDF file.

I suggest that you send a message to Alex telling him that you know damn well that he is linked with the dealers. Warn him now that when it goes to court (when, not – if) that you will also be exposing their fake little independent arbitration scheme to the judge.
Telling also that you will be exposing their fake arbitration scheme to the finance company as well.

Telling that as far as he's concerned, he should consider that the game is up on this one

 

In fact you could tell Blue Motor Finance right now that the motor complaints thing is actually a fake arbitration scheme that is run by associates of the dealers. Explain this to the finance company and tell them that this shows what a crowd they have got caught up with – and the quicker they organise your refund the better because of it goes to court, then you will expose their relationship with this operation

Incidentally, at the point of sale or on a website or anything, do they make any claims in respect of the so-called arbitration service run by Alex?

I’ve just checked and couldn’t find anything about their “customer service Alex” on https://www.chobhamcentralgarage.co.uk

First time we heard from Alex was on the day after we spoke about rejection of the vehicle with Nathan ( who sold the car ) . Then I asked Nathan who is Alex and why he is sending us emails saying that they want to repair the car . 
Nathan said - this is our customer service. It’s a company represents many other companies as a customer service

Yes well it's a scam outfit. They used to have a website – and that doesn't work anymore. It used to be Automotive Vehicle Brokers Limited trading as MotorComplaint 

.

It was in operation trading under several companies names and any time they would get a complaint they would forward it to motor complaints apparently to get an independent investigation and decision.

Of course it was simply a scam which had been set up by them but the problem is that the customers thought that their complaint had been properly investigated and even though they were not happy with the decision, they thought they had no more rights.

It was a disgusting piece of dishonesty and as hard as we tried, we couldn't get anybody to take any notice – not the police, not trading standards and only the daily mail eventually got involved and after that, everything quietened down that we now have your case and also another case with a guy called Noel Quail operating a company called Mychett First which seems to be using a same address as one of the previous companies and whose name came up in relation to them before as well.
 

Do you have the surname of any of these people you've been dealing with?
 

I would suggest that you don't have anything more to do in writing with any of them. Keep it absolutely specifically with Blue Motor Finance which themselves may be not highly reputable – but at least they are regulated. And of course the most important thing is that you haven't actually paid much money. You only pay the deposit so far as I can gather and the rest of the money is owing so eventually we will be able to help you invalidate the transaction and at the very worst you will have lost a little – and at the very best, you will get it all back

Also, the daily mail discovered that some of the people were using a variety of different names and in fact it was very difficult to find out who was who and which names were completely false.

It's really quite an extraordinary outfit. If they appied the same amount of energy to making an honest living, they would probably do very well for themselves

Yes, exactly what I find out after research the website motorcomplient.com doesn’t exist. 
 

Unfortunately I don’t know any surnames. I’m even not sure if Alex and Nathan are their real names . 
 

I’ve just noticed that the receipt( for the deposit ) is from IMPERIAL MOTOR GROUP if that matters.

Just stick to the finance company. It is completely their responsibility and it's much easier because you have got a single target.

If they look like mucking you around then Tuesday or Wednesday will send them a letter of claim. Have read on the forum about the steps involved taking a small claim in the County Court – make sure that you will be happy to do it if necessary.

So sorry that you're going through this scam. The person you are dealing with at Motor Complaint is a guy named Alex Brodie. 

 

As BankFodder as already stated, this "company" is not an independent company, but is rather an organised setup ran by a syndicate of very dodgy people. 

 

When dealing with BMF, please also state to them that the garage has had the car on previous occasions in an attempt to repair the issues, and has now confirmed your decision to reject the vehicle, which is your right under the Consumer Rights Act

 

Please also contact your bank, and let them know to cancel direct debit

By the way, before the car is returned, please would you take photographs of it including the registration number so they can be put up on this forum in case future purchasers come across it and they will then know that there is already a story behind it.
