    • There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • thank you you mean you got a notice of discontinuance? dx
    • Thanks for your interest dx100. Didn’t reach a hearing. Although they filed court papers, they withdrew a few days beforehand, and admitted it was statute barred and I have it in writing that they say the matter is now closed. Once again, many thanks for all your help.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi there,

i'm in the process of readying my summary cause claim against RBS, details here:

daver1975-vs-RBS

i've run into a couple of head scratchers though, been reading the whole forum for a couple of days, but no definitive answer. i hope someone can help. (also *just* found the scotland section, tucked away, not easy to find!)

i sent off LBA etc to RBS, claiming back approx six years, before i fully understood that we're only allowed to claim five years in scotland? now, i'm thinking i might leave it as it is, and see what happens. i've read of other people just not getting that portion back, and others getting full amounts.

what do you all think?

also, the second question is this: does the 8% spreadsheet calculator apply to us here in scotland too? i was all set to go with this, and claim like £400 more using this spreadsheet, but then i read a few posts saying we couldn't use it for our scottish claims etc?

i'm a tad confused, and disappointed i only found this section of the forum 2 days before filing my claim at court!

*head spinning!*

thanks a lot you guys!

Hi

Don't really know about the 6years/5 years dilemma - I have used 5 years as a yard stick - maybe those getting money back for the 6th year are based in England?

Re the 8% interest - I have always included this in the court forms (I have gone down the route of small claims) - although to be honest the two claims which have been settled by the bank have not included this calculated interest amount - I have recently written to the court asking if I can pursue claiming this as it was part of the claim filed and which was eventually settled!

BoS-sm claim1 return date 23.11.06

£633.12 settled 05/10/06 (no 8% interest!!!)

BoS-sm claim2 return date 07.12.06

£512.00 settled 04/12/06

BOS - sm claim 3 lodged 02.11.06 for £701.86

I claimed and got my 8% from BOS. They paid up just before it went to court the full amount minus interest and I said unless they paid the interest I would continue with my court case as they hadn't settled it in full. It took a bit of arguing but I got it all paid. Stay firm and you will get it!

BOS - PAID IN FULL

Barclaycard - NEXT!!!
