    • Good afternoon, I am writing because I am very frustrated. I received a parking fine from MET Parking Services Ltd , ( Southgate park Stansted CM24 1PY) . We stopped for a quick meal in Mcdonalds and were there fir around 30 mins. We always do this after flights and never received a parking fine before.  Reason: The vehicle left in Southgate car park without payment made for parking and the occupants southgate premises. they took some pictures of us leaving the car. i did not try and appeal it yet as I came across many forums that this is a scam and I should leave it. But I keep getting threatening letters.  Incident happened : 23/10/2023 I did contact Mcdonalds and they said this:  Joylyn (McDonald’s Customer Services) 5 Apr 2024, 12:05 BST Dear Laura, Thank you for contacting McDonald’s Customer Services. I’m sorry to hear that you have received a Parking Charge Notice following your visit to our Stansted restaurant.   We've introduced parking restrictions at some of our restaurants to make sure there are always parking spaces available for customers.   We appreciate that some visits such as birthday parties or large group visits might take longer and the parking restrictions aren't intended to stop this. If you think your stay will exceed the stated maximum parking time then please speak to a manager in advance.   Your number plate is scanned by our Automatic Number Plate Recognition (ANPR) system when you enter our car park, and then again when you leave. If you have overstayed the maximum time allowed, you will not be notified straight away- a Parking Charge Notice will be sent to you via the post.   If you feel that a Parking Charge Notice has been issued in error, please contact our approved contractors who issued the charge in order to appeal the charge. Unfortunately McDonald's are unable to revoke parking tickets- the outcome of the appeal is final and cannot be overturned by McDonald’s.   Many thanks for taking the time to contact McDonald’s Customer Services.   Can someone please help me out and suggest what I should do next?  Thank you 
    • Good Evening, I've got a fairly simple question but I'll provide some context incase needed. I've pursued a company that has operations in england despite them having no official office anywhere. I've managed to find a site they operate from and the papers there have been defended so I know they operate there. They've filed a defence which is honestly the worst defence ever, and despite being required to provide their witness evidence, they have not and have completely ignored the courts and my request for copies of it. I'm therefore considering applying to strike out their defence on the grounds the defence was rubbish and that they haven't provided any evidence for the trial. However, it has a trial date set for end of june, and a civil application wouldn't get heard until a week before then, so hardly worth it. However, my local court is very good at dealing with paper applications (i.e ones that don't need hearings, and frankly I think they are literally like 1-2 days from when you submit it to when a Judge sees it. I'm wondering if I can apply to strikeout a defence without a hearing OR whether a hearing is required for a strikeout application.   Thanks
    • I have just opened another bank acc with lloyds (i have a few already) After doing some research they may have some relation to tsb or be apart of the same group will this cause me issue if my salary is paid into my lloyds account? Also, if the debts do go into default and nothing is paid then after 6 years it all goes away? As the DCAs cannot do anything? I do want to start paying in like 3/4 months or do you advise I leave it if it goes into default? again sorry for all the questions, i am just processing everything

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello - first post so please be gentle with me!

 

I am claiming back £1,240.00 in charges from Halifax Bank, after reading through tons of stuff first!

 

But I have a couple of questions.

 

1 - I have all my bank statements (never thrown one away!). So I started to input the charges onto the spreadsheet for Excel. On my statements they are all marked as "Charges as Notified", and not Unpaid DD, or Unpaid Chq, which is all they could be on this type of account. Can I change the spreadsheet to read "UNPAID DD/CHQ CHARGE"? Also, they add them together, so 3 charges ina a month will show as £84, not 3 lots of £28, should I separate them?

 

2 - I have NO overdraft, and have never been charged for going into overdraft. So do I just delete the 8% Interest column?

 

3 - In the prelim letter, in the paragraph headed "What I Require" - I have changed to read "I calculate that you have taken £1,240.00 in bank charges and seek to have those paid back into my account". This is because some of the paragraph didn't apply and I wanted it to read correctly - is that ok?

 

4 - And Finally (honest!) I changed the second line of the letter to read "I now understand that the regime of fees, which you have been applying to my account in relation to direct debit refusals, unpaid cheques and so forth.......", again to apply specifically to my case. Is that ok too?

 

Everything is printed, signed and ready to go - just awaiting some help first!

Charges as notified is absolutely fine.

Not exactly. You do not include the column when you send off the Preliminary Letter or the Letter Before Action, however you will need the 8% column if you file at Court. The 8% is added to the claim under s.69 County Courts Act - think of it as a bonus for all of your hard work, or as is more correct, the interest that you could have gained had the money the bank taken been in a savings account.

Should be fine.

As long as the overall meaning of the letter has not been changed then, again, you should be fine.

OK, Thank you for all that - the letter has gone off recorded delivery! Hope it went to the right place, as there was no-one around last night for me to ask, so I searched a couple of threads and found an addy for Customer relaitons with a POBox number in Leeds.

 

I will let you know how I get on!

After reading through a "tonne" of threads, I noticed some people are still banking with the Halifax. Is it the case that if you are not overdrawn with them that the account seems to stay open, but if you are in credit then they pay the money back into that account and you can continue to use it?

 

Just wondered!

Is this pretty standard? I am not a current account customer, I have a Cardcash account with Visa Electron card. Does that mean I can't claim back the £1,240 they took? I feel a bit nervous now where I didn't before and wonder if thats normal?

.......when I entered my schedule of charges onto the spreadsheet, I didn't know what description to put - I did ask on here, and whilst I waited for an answer, I just put "Unpaid DD/CHQ charge" in the column (statements say Charges as Notified). I had two spreadsheets on the pc because it took me ages to work it out. After getting the correct info from here, I changed the wording to Charges as Notified. Only I have printed and sent the wrong one!" I am such a muppet - so my wording says "Unpaid DD/CHQ charge" for every transaction! They are the only types of charges I can get - have I screwed it up?

You should be fine although it is still possible to send another copy of the "proper" schedule of charges to the bank and to the Court with a covering letter stating that this is the finalised schedule of charges and supercedes any previous schedules issued in relation to the claim.

 

As long as the figures on the schedule match the figures on the claim there shouldn't be anything else to worry about.

OK, I have received an offer of £365.00, which they say is six months of charges - but which six months cos I only paid one charge in the last 12 months!!

 

Anyway, I refuse now don't I? What happens to the timetable now? Do they get the rest of this 14 days, cos today is only day 6 of my claim, and do I send the LBA now, or after their 14 days is up? I think I have seen a refusal letter in the library - will go and have a look now, I just need some help getting organised as I am not the most organised person in the world!

Hi everyone,

 

I waited until today to refuse my offer from Halifax, as it was time to send the LBA. So I have done that and amended it according to advice from the forum, so thank you for that.

 

Just sit tight and wait and see now then!

Hi everyone,

 

I sent my LBA and had a standard response...."we offered you £*** but you have declined.....we will not be paying you back your charges.......failure to manage your account properly could result in colsure of your account"

 

So, I am now ready to take the next step.....trouble is I can't! I have no idea what to do now, I know I have to go to court (not MCOL as I can file for free at court) and I need to know what forms to fill in, what submissions I need if I need them.....

 

Sorry, I am not usually this helpless but I had three OU assignments to be in and they had to take priority!

 

If anyone can offer some freindly advice I wuld be very grateful.

If you go online, you can fill this in by using the template on the site, it lets you line everything up, makes it look really good. Its the N1 form, you need 3 copies if your going to your local court, plus 3 lists of charges that were made from the bank. Don’t forget to add the daily interest rate, at a daily rate of £0.xx; - This daily rate of interest is calculated by multiplying the total value of the claim (charges plus overdraft interest, if claimed) by 0.00022

I am off to court tomorrow to file my claim. I have held off for two weeks, totally unneccesarily because of the £120.00 charge, but I called in today on my lunch break to find out I don't have to pay them! Wish I'd known - I could have had the money for Christmas!!!!

 

Anyway, before I go, do I have to submit any evidence other than the schedule of charges at this stage?

 

What I have prepared is three copies of the N1 and three schedules. Should I be producing supplementary documents now, or in court should I get a hearing?

Hi Pink,

 

I also found that at about your stage when i was convinced i would be the one to be challenged and lose in court, that reading some success stories helped me to calm my nerves. You'll be fine, but do keep reading!

Ok everyone, I have filed my claim in court. Very easy - but I have made a mistake - do you think it will matter? On the schedule of charges I put my Branch address - but the N1 has the Banks head office on! I have never counted on getting the money back, so its no great drama - just wondered!

 

Now waiting the 14 days to hear if they submit a defence. The papers will be served on Monday according to the court clerk and so 14 days is up on the 22nd.
