    • There's a thread somewhere about someone sending the baillifs against Wizzair that is quite hilarious. I would love to see someone do the same to Ryanair. Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, thats the presented view from the right

as low economy, low regulations is what the brexiters are pressing for

.. see rees mogg very clearly and literally state it a little higher in the thread ..

What they wanted though was EU benefits, singapore on thames low cost labour low (company and millionaire) tax, low regulation, low environmental rights (which they have with water companies - the brexiter model - apart from the occasional fine which is less than the money they made)

BUT

Indeed. I can se both sides of that debate, UB. What's more concerning is voter ID that could stop poorer people and minorities [non-Tory supporters] from voting, the ability to strip immigrants of their citizenship without giving a reason, stopping the ability to protest and so on.

Next week will be interesting, won't it? I hope it goes better than last year.

Did you see Johnson's article on the advantages of Brexit so far? A lot of it was about having crown marks on pint glasses and being able to buy and sell things in pounds and ounces, plus trade deals with small countries that are nowhere near offsetting lost business from the EU.

Oh, and the new immigration system. But there's already talk of allocating a lot of visas being awarded if a trade deal is signed with India...

No, Britain has the most to lose and HAS lost the most, Its quite clear

- and made far worse by Johnsons corruption, incompetence and dishonesty

- with not just our benefits from EU membership lost, but our position in the world belittled by his antics. Not least of which the Afghanistan farce.

From the remaining EU members France may have the most to lose, and perhaps even lost the most, BUT also has a great deal to gain, and HAS gained MUCH - quite possibly far more than it will lose.

Just a couple of examples:

Seen all that business bypassing the UK and running straight from Ireland - France?

Have you seen the financial migrations to Paris? (even though Paris isnt the greatest gainer from UK finance business losses)

Mind you, a number of  EU migratory workers have lost some business in the UK (Hospitality, care, Transport and Agriculture)

- but see what its done to the UK businesses?

Just look at the headlines and remember the fuel shortages .. and the state of supermarket shelves still ..

Mind you, there have been a number of new UK financial roles

- specialists in moving businesses to the EU by and large it seems ..

"“The hero is the Prime Minister who delivered Brexit. I’m aware as someone said today that regicide is in the DNA of the Conservative party, but a bit of loyalty to the person who won an 83 majority and delivered Brexit wouldn’t go amiss.”

Johnson accuses anti-vaxxers of spreading 'complete nonsense' and 'mumbo jumbo'

"Boris Johnson has condemned anti-vaxxers for spreading “complete nonsense” and “mumbo jumbo” about vaccines. In a pooled broadcast interview during a visit to a vaccination centre, he stressed the importance of vaccination, saying 30 to 40% of patients going to hospital with Covid had not been vaccinated. He went on:

I want to say to the anti-vax campaigners, the people who are putting this mumbo jumbo on social media: they are completely wrong. You haven’t heard me say that before, because I think it’s important we have a voluntary approach in this country and we’re going to keep a voluntary approach ...

What a tragedy that we’ve got all this pressure on the NHS, all the difficulties that our doctors and nurses are experiencing and we’ve got people out there spouting complete nonsense about vaccination."

Is Johnson actually telling some truths at last? No matter how hard it hits his support base Bonkers Brigade?

- Incidentally perhaps, but seems to me he's just still trying to get toppled so he can run away and claim its all not his fault
