Yesterday I won my POPLA case against Civil Enforcement's PCN.

 

The assessor said that they missed out wording in paragrah 9(2)(f) of Schedule 4 of the Protection of Freedoms Act 2012:

 

The notice must:

 

(f)warn the keeper that if, after the period of 28 days beginning with the day after that on which the notice is given—

(i)the amount of the unpaid parking charges specified under paragraph (d) has not been paid in full, and

(ii)the creditor does not know both the name of the driver and a current address for service for the driver,

the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid;

 

If your PCN does not contain this wording - it is invalid.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I can't disclose the location otherwise CE will know who I am.

 

However they may use the same wording for all of the PCN's that they issue.

Besides what does it matter if they know who you are?

 

What are they going to do??

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

So if it doesn't matter why does CAG always recommend posters delete their personal info? Why not just leave it there?

🕵️‍♂️   Becaues if you did leave your personal identifiable data...then they would know who you are

I have nothing against the owner of the land as I know them personally. However I do have an issue with CE. That's why I won't state the location. Happy?

Not sure why you didn't get your friend who owns the land to have the invoice cancelled?

Hacksaw it is always good to learn of the parking crooks get beaten. And we are always looking for extra ways in which we can help our members not having to pay these speculative invoices. However if we do not know what the missing words are it is of little use to us or our members in the same boat as you.

I have read many times that part of the notice you quoted in your first post. The only words missing from another CEL PCN  seem to be  "are met".  Is this your understanding of where CEL went wrong in your case or was it something different and please advise us what thw words were. And whatever the missing words were, was it something you saw yourself in your appeal or did you read it somewhere.
