Well how unsurprising. Not being funny but he refused to accept the problems and pay you. I did not expect him to pay this. Send in the bailiffs see if you can get the high court ones.

I have asked for the court bailiffs I wasnt aware I can go to the High Court for enforcement by High Court enforcement officers, do I need to change to the High Court enforcement officers then ?

Here's a slapped wrist – we are bending over backwards to help you and give you the best advice and then you rush off and do things without consulting us.

This must absolutely be enforced by High Court enforcement officers. This guy is slippery and he may not even pay the sheriff's but he certainly won't pay county court bailiffs.

You should cancel whatever enforcement you put in progress at the moment even if you lose the money and you should access one of the websites operated by High Court enforcement officers and for £66 you will have the judgement transferred up to High Court and then for a very rigourous enforcement.

These people have huge powers and they generally speaking stand for very little nonsense. They are very expensive – typically £2000 which will be paid on a no enforcement no fee basis by the defendant.

Check with the High Court enforcement officers website that that is the fee system they are using but I think they are all using it.

It's extremely important that you attempt to have this enforced by the High Court enforcement officers.

County Court bailiffs have a very poor record of enforcement – when somebody is trying to avoid it.

For judgements less than £600, you are obliged to use county court  bailiffs but over £600, suddenly you have access to the High Court enforcement system and and it makes no sense at all not to use it especially when you are dealing with the kind of defendant that you are up against.

If I were you I would identify a particular High Court enforcement service – and then call them and discuss what you consider might be the various problems in enforcing the judgement – including possible different addresses et cetera and get advice from them before you then begin the transfer up process.

You could take the opportunity as well just to confirm that the enforcement fee will be paid by the defendant and that in the event of no enforcement, there will be no fee for you other than the transfer-up fee

I'm afraid that I have no experience of this and you will have to decide for yourself. We wouldn't make references to one company over another anyway. We have no skin in the game – we don't get commissions. I'm simply pointing the best way forward.

Just been to the moneyclaim.gov.uk site and there isnt a way of stopping the warrent so I assume it will just go ahead unless they contact me, but I will go ahead and get this upped to the high court and will let you know how I get on thanks again

In that case call one of the High Court enforcement offices and tell them what you have done and that you have accidentally begun a county court bailiff execution and asked them how you can deal with it because you really want it executed by the sheriffs.

Just done that and they said I have to get it stopped

at this moment I am awaiting being answered on their MCOL phone line

 

I will let you know how I got on then

 

Hi again they said it cant be stopped so to go  ahead with the CC baliff's and then if he doesnt pay take it to the high court.

Hi again the only thing I know is that the CC baliff's have been given the job but I havnt heard from them yet, I thought I would have been contacted as its been 21days since they were told to go after him, it would have nice to have been told we are behind and catching up etc,  but nothing so far, have you any idea how or if they contact me about whats going on?

I'm afraid that this is a result of you instructing bailiffs. If you had instructed the sheriffs – High Court enforcement officers, it would have been a done deal by now

Well I should keep on the bailiffs case – phone them regularly and asked them about withdrawing the warrant from them and then transferring out. Speak with a High Court enforcement officers and tell them what has happened and tell them that you have made a mistake and what should you do to have the matter transferred to them. They may well have experience

I have not been given any numbers by the CC for me to call the CC baliifs, I was hoping they would have contacted me by now to ask them, how would I find out who the CC baliffs are please? 

 

But I did contact two of the HC compaies you gave me and they said they cant get involved untill the CC has got as far as they can, as there can't be two warrents at the same time for the same judgment.
