Probate and Nasty Partner

My father passed 2 months ago

His partner is an executor of the will

Probate will take until the new year

I am his only son

She is telling all and sundry the supposed contents of his will

 

Its been awful and i hope i can get some sound advice on how to deal with her and what my rights are

You say his partner is "an executor" Are there others? Who?

 

I'm not sure what it is that you want to do? Stop her telling all and sundry what's in the Will? When I've been an executor I didn't announce it to the whole world, but AFAIK there's nothing in law to stop the Executor telling anyone and everyone. Wills are public documents (after probate has been granted anyway). Anyone could get a copy of anyone else's Will and publish it all over the internet if they felt like it.

 

I doubt you have any rights if you are not an Executor.

there are 2 trustees to my estate

 

we want to get in touch with the tenant of the trust - the person living in the trust house

 

we wish to make a site survey and view all the insuarance policies to see the house is in order and the bills are paid

 

whats the best way to do this o mighty forum

I'm a bit confused about what you mean by 'estate'. Usually here, it means what someone leaves behind but clearly you're still with us.

 

Could you elaborate please?

i have been left the house in the will but presently his partner not wife can use the prop until death

 

the 2 trustees of the estate want to get information regarding the house from the tenant

Have they asked and the tenant not cooperated?  Are you asking what (if any) powers they have to get the tenant to comply with a survey and produce insurance documents?

 

EDIT:  Seeing the other thread from over four years ago, what exactly is the problem?  (It helps in providing an answer... )

wow thanks for the research - id completely forgotten how stressed out i was then!!!

 

so now its moved on 

 

without going into detail the trustees at the time liquidated everything cheaply ( another issue for another day)

i installed new trustees after mediation ( another story for another day)

everybody is paid off and she now resides in  a property provided by the estate

 

we / they want to site survey etc 

 

how would they/ we go about this

I repeat - have they asked and been rebuffed, or haven't they even approached the tenant yet?

 

Do you/they have reason to expect the tenant to be co-operative or obstructive?

Well unless you or the trustees think the tenant is likely to be obstructive (you haven't elaborated) why not just ask them?

 

(It seems to me to be the obvious first step to take, but I'm a little concerned that you seem to be anticipating that there may be a difficulty here which you seem reluctant to spell out.  I'm assuming the tenant is the former partner of the person who left you the estate from your earlier thread and that you had some sort of issue with.  I think it will help others give more appropriate and helpful advice if they know whether this situation is likely to be amicable or not).

well for myself iv no grudge with this woman

she has been so awful toward myself but life moves on - i hold no grudge

i just want my trustees to make sure the estate is looked after

 

i dont want anything but a business like approach to the estate 

 

and as we are all beginners in this id hoped for some advice to get the ball rolling

 

we can write to her - its just what is the proper way to approach

So did your father set up a Will Trust to hold his estate for you and any other beneficiaries but made his partner a lifetime tenant or gave her a lifetime interest in his estate?

 

You sound quite close to the trustees. Are they beneficiaries as well?

no other beneficiaries - my half sister ( mothers side) Best Friend are trustees - the tenant was happy with this - she is the lifetime tenant

 all the other issues of the will have been sorted out in mediation

I'm no expert but it seems to me that the trustees need to be careful that they act impartially. Maybe ganging up with you against the partner isn't the best way to go about this, or have I misunderstood something?

Fair enough, it's just that you're talking in terms of 'we'. Trustees aren't meant to favour one beneficiary over another.

 

As Manxman said, have the Trustees asked the lifetime tenant for the information?

the trustees wanted to make a formal enquiry - the tenant can do as she likes with our request
