      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can wait to see if hear anything else from email I've sent. But if reply is same what's my next move

 

Think account was actually moved to  recovery team in 2008, but only sent statements from January 2011. No sign of cca in sar report either

Received rest of statements.

Also included all ppi info, claims and refund details.

Cca agreement included.

 

Statements going back to March 2006 purely contain repayments coming off balance.

 

Feb2006 - 2002. Consist of statements with purchases, interest charge and ppi payments. 

 

Only one other charge is late payment fee on nov 2005 statement.

i'd cut out AIC totally , don't give them a penny.

Aic are collecting money on behalf of RBS, I have received no post from aic for nearly 2 years. I am currently paying monthly to them. I asked for a CCA agreement 2 years ago but they told me to get in touch with RBS. Any advice

What is the debt?

Credit card, overdraft, loan?

 

How much are you throwing away to AIC each month?

 

How did you request the CCA, in writing or over the phone?

 

If you requested the CCA in writing and AIC palmed you off with that statement then STOP PAYING.

 

What does your credit file say about this, and any other, debts?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

RBS mint credit card.

£8.50/MTH.

Originally requested CCA from aic, they told me I needed to request it from RBS as they were the oc.

Requested CCA from RBS and they sent me a digital email of CCA agreement which they appeared to have all the credit reports and agreements.

After recieving that I have continued paying monthly as I thought that the debt was still held by the oc.

I haven't had any written correspondence from aic regarding balance owed or any statement or acknowledgement of my payments.for nearly 2 years.

Please advise on what I should do next.

Check your credit file.

 

When did you take this card out?

 

What was the total balance on it?

 

Have you reclaimed all late payment fees and charges?

 

You should be getting a 'statement of account' at least every 6 months which will tell you the state of the account, how much you've paid in and the current balance outstanding.

 

They have stopped all interest haven't they?

 

So you requested the CCA via email?

 

STOP corresponding with them via email, you need to have a paper trail of evidence and everything must be in writing, this is how they run rings round their victims.

 

Have you shown anyone what they have sent you?

Nothing is currently showing on my credit file.

Mint card originally took out approx 2005

Total balance about £4k.

Had no written correspondence since April 2021.

I requested CCA in written form to aic.

I also sent written CCA request to RBS.

As far as I can remember I had a email attachment with report from RBS.

Cannot access it anymore for some reason.

Should I stop paying and see their response
