      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What exactly do you ask them for in the SAR? Why did you send them the SAR?

Well by all means speak to them – that you should say as little as possible and let them do the talking. Take notes – but better still record the call.

If your SAR is based on our template which basically means that they have to disclose everything, then if they start asking you what specifically are you looking for, you simply go very blank and say that they have got your SAR and it's very clear and you are not prepared to make any comment on it.

Also, remind them that the clock is ticking. Your deadline is firm. And if they don't comply by the 30 day deadline then you will sue them. If they leave anything out then you will sue them.

I would suggest that you be quite dismissive.

If they phone you and start asking you for passwords or ID et cetera – you should tell them that they have decided to call you. It's up to them to provide you with some kind of ID and if they won't then tell them that you are prepared to go ahead with the call. Simply remind them that the clock is ticking.

In other words I would be broadly uncooperative and make them realise that this is a serious matter and there is no negotiation and no discussion

the idea of the sar to RBS was not about enforceability but more to findout how much of this debt is made of unlawful penalty charges etc.

the card is still owned by the original creditor , once we know the above details you might well be sending a CCA request.

 

no harm in talking to them, you want ALL the information they hold on you for your own personal financial ecords (don't say WHY!!) .

Been on contact with RBS and asked for information they hold on me. Informed that my request will be processed but said that there were no active accounts

Had previously sent a cca request to Aic whom I thought held the account, they responded saying if I require a copy of the cca, a letter asking for a copy, signed by the account holder and the client reference, they will then forward this to their client to allow them to provide this information. The cca already sent to aic only included their ref no. Not the RBS customer ref.

What steps should I take now.

RBS mint cc now managed by aic international.

Sar response is statements from January 2011 to present. 

All statements are showing balance and monthly agreed repayment. 

Please advise on next action

so you now have all the statements from day one...

 

have a look for fixed sum £12 penalty charges. over/late/letter

they are all reclaimable....

Not sure probably around 2006-8.

1st statement they've sent is Jan 2011 and just say balance brought forward from previous statement.

Only appear to have sent statements after going on payment plan

The only other thing on any of the statements is a ppi refund paid off balance in 2012 for premiums paid between 2002 and 2005

 

Have requested earlier statements,  looks like account originally opened approx 2002

Rang RBS,  bit vague but said statements were only kept for certain period and what they've sent is probably all they have. Sar request details were done online and sent by email. I have replied via email but not had a reply as of yet
