Hi

 

I have already posted two topics on here regarding my claim against Barclays(see links below), but after reading through hundreds of other posts I'm still unable to find any info on whether Barclays have ever (if they do?) taken people to court ??!

 

Does anybody know of any specifice cases of which Barclays have GONE to court ??

 

I have had a few replies, and read other posts from people saying how banks pay up before the court hearing. But I dont know whether these are in specific relation to Barclays Bank, and I would like to know about them really.

 

I've followed the whole bank charge reclaim process through as normal, and after submitting my allocation questionnaire, I have received a court hearing in the small claims track on the 23rd february 2007.

 

Looking to hear from anyone who has experience here??

......or know of anything similar that happened with Barclays ??

MOCL filed 11/12/06 - deemed served 17/12/06

MOCL acknowledged 29/12/06

Non compliance with S.A.R - (Subject Access Request) letter sent 04/01/07

Statements Received 08/01/07

MOCL Defended 12/01/07

AQ received 17/01/07

AQ done and delivered 19/01/07

Hi People

 

I'm looking for a bit of help here !!!

 

I'm nearly fiished putting my court bundle together, but am still in need of the following five documents. Could anyone please point me in the right direction as to where you go them from, or even better post them up (Sorry for being cheeky)

HOC Treasury Report on Charging.

 

Sale of Goods Amendment Act.

 

Peter McNamara interview transcript.

I really want my court bundle to be "the business"!! Because knowing my luck, I'll be the one who ACTUALLY has to go to court haha

lol don't panic,

 

there's a 99.9% chance your case won't end up in court..

10/06/06 - S.A.R - (Subject Access Request) sent.

21/06/06 - Statements received.

05/10/06 - Prelim letter sent.

19/10/06 - LBA sent.

02/11/06 - Offer received for £700.

12/11/06 - Rejection letter sent.

23/11/06 - MCOL submitted (£1,890.27 with 8% interest).

24/11/06 - Charges schedule sent to bank & court.

28/12/06 - Barclays file defence/AQ received from court.

14/01/07 - AQ & charges schedule sent to court.

As far as I am Aware the furthest it has been pushed is the claimant attending court with Barclays failing to do so, Obviously they lose straight away then, I have not come across ANYONE having to face any legal bods from Barclays inside a court room.

Think about it, there legal bods would charge them MORE for one court appearance than they would be paying out anyhoo, simple maths even THEY get that part right.

Fingers crossed for you. Apologies that I didn't send you the letter template, things have been pretty chaotic and I haven't been well -so now really behind with it all!!!

 

And now I dare to ask you something...where did you manage to get the remaining documents for the bundle? mine's not finished yet and will be working on it this evening. Have you had a conversation with Barclays yet?

(14 days before the set court date of 23rd February)

I basically just trawled through the library of this site, whilst also looking at other peoples posts who have done it before, and picked up on their links to web pages, etc.
